California — Professional Photocopier Bond

California’s professional-photocopier registration concerns obtaining or reproducing the confidential documents specified in Business and Professions Code § 22450 for compensation. It is not a general bond for every copy shop. The registration requires $5,000 security, and The Southern Agency’s listing provides the surety-bond application route.

What this bond does

Section 22455 conditions the $5,000 corporate-surety bond on compliance with the professional-photocopier chapter and the specified laws governing transmission of confidential documentary information. Its total aggregate liability is $5,000. Registration is through the applicable county clerk, who delivers the filed bond to the county recorder.

Who needs it
The person, partnership or corporation that needs registration for the defined confidential-document work. Check the statutory exemptions first: they include employees/agents of a registered professional photocopier and specified attorney-related, government, court-appointed, records-custodian, and other roles. Performing copying work does not automatically mean each employee needs a separate registration and bond.
Who it protects
Under § 22459, someone who recovers damages in an action or proceeding for injury from the specified improper obtaining, transmission, distribution or disclosure/noncompliance may recover against the bond or permitted cash deposit. It is not automatic compensation for every copying error, a general cyber policy or permission to obtain records without lawful authority.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify the registrant and the records work

Describe what documents you obtain or reproduce, under what authority, and who has access to their contents. Section 22450 ties this registration to particular Civil Code and Evidence Code provisions; a retail copier description alone does not establish the regulated activity.

Check the county filing for the registrant’s residence/principal place of business and branch offices. An individual application differs from a partnership/corporation filing with general-partner or officer information. Have the actual applicant and county’s accepted form/recipient wording ready, rather than naming an employee or DBA alone by assumption.

Maintain the management notary commission and accepted dates

Section 22454 requires at least one person involved in management to hold a current California notary commission throughout registration. If that person is someone other than the registrant, written authorization to use the commission is required. Keep the commission current and update the county if it expires early. This is a management/registration requirement, not the same thing as notarizing the bond.

State registration lasts two years or until the bond expires, whichever is earlier. Renewal may be filed up to 60 days early, taking effect when the current registration expires. As a local example, Los Angeles County’s individual page asks for $5,000 with a two-year term and start/end dates; its linked notary-authorization form repeats the management-commission rule. Follow the county’s actual instructions, not a term inferred from this unlabeled public option.

File the correct condition and restore security after recovery

Purchase Now opens Propeller in a new tab. Match the registered applicant, $5,000 amount, § 22455 confidential-information condition, county-accepted recipient/form, and actual effective period. Deliver the issued document using the clerk’s current instructions; the statute provides for recording through the clerk and recorder. County registration and lawful document access remain separate from purchase.

Section 22459 requires a new bond or additional cash within 30 days after a recovery to restore the required security; otherwise registration is revoked. That restoration period is not a general grace period for starting work unregistered. The State also allows a $5,000 cash deposit with the clerk instead of the surety route.

Sources

Have these ready

  1. Actual regulated records activity and applicable exemption/registration decision.
  2. Individual or partnership/corporation registrant, legal name and relevant county/branch filing details.
  3. Current management notary commission and written authorization if held by someone other than the registrant.
  4. County-accepted $5,000 condition/form, recipient wording, and effective/expiry dates for initial or renewal filing.

Questions about this bond

Does every employee who copies records need a separate bond?

Section 22451 exempts an employee or agent of a person registered under the chapter. Confirm the actual registration and role; do not assume every operator needs an individual filing or that all copying services are within this chapter.

Must the management notary always be the individual registrant?

State § 22454 allows a current commission held by another person involved in management, with written authorization when someone other than the registrant supplies it. The commission must remain valid during registration; follow the county’s actual documentation instructions.

Will the registration always last two years?

It ends at two years or the bond’s expiry, whichever is earlier. Match the accepted dates and maintain the notary commission. Los Angeles’s individual filing requests a two-year bond, but this public option itself supplies no term label.

What happens after damages are recovered against the security?

Section 22459 requires restoration to the required amount within 30 days by a new bond or additional cash, or registration is revoked. The aggregate bond limit is $5,000; it is not a fresh limit promised for each injury.
