Chesilhurst, NJ — Street Opening Bond

Chesilhurst's street-opening rules distinguish security for one opening from an annual programme covering up to ten openings. They also separate the performance guarantee from maintenance security after restoration. Have the Borough Clerk and Engineer identify the arrangement, amount and form needed for your work before applying.

What this bond does

Secure the applicant's permitted opening and restoration of Borough-controlled right-of-way under Chesilhurst's street-opening requirements.

Who needs it
The person or company applying to the Borough Clerk for a street-opening permit, with contractor, owner and utility roles identified.
Who it protects
Performance security supports the accepted street-opening work until written release. Maintenance security then addresses the condition of the restored road after final acceptance; neither instrument is the permit itself.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify one opening or an annual programme

Section 420-6 describes a $30,000 annual corporate bond for one through ten openings, with additional security required if the contractor exceeds ten. Its individual-opening alternative is a $3,000 bond or certified-check deposit for an opening no larger than the stated 95-square-foot threshold; larger openings require additional security based on the affected improvements.

Use the actual opening dimensions and the Engineer's calculation. Do not assume the annual programme allows unlimited openings or that the base individual amount applies to a larger trench.

The performance-guarantee provision requires continuing security without an expiration date until the Engineer's written release reaches the Borough Clerk. An annual work programme does not mean that outstanding restoration obligations disappear at the end of a calendar year. Have the issuer match that condition before issuance.

Plan for maintenance before performance release

After road-opening restoration and before release of performance security, the code calls for a maintenance bond of 15% of the original guarantee, addressing two years after final acceptance. Utility companies may satisfy that requirement through appropriate language in the annual performance guarantee. Do not assume a private contractor's purchase automatically includes both instruments.

Prepare the Clerk's application and required drawings, proposed commencement, completion and restoration dates, and any detour approval. The permit identifies the opening and work period; the code requires work to commence within 30 days unless the Engineer grants a written extension, and a 48-hour notice to the Engineer and Police before ordinary openings.

Purchase Now opens the existing Propeller application, with no fixed amount or term listed. Match the required individual or annual form, principal, Borough recipient and continuing-performance conditions, then file the issued security and other documents with the Clerk. Obtain the permit before work and follow the Engineer's inspection and written-release process.

Questions about this bond

Does the annual bond cover unlimited openings?

No. Section 420-6 describes $30,000 for one through ten openings and requires additional security above ten. Have the Clerk and Engineer confirm the openings and available guarantee.

Does an annual programme allow the performance bond to expire automatically?

The code separately requires performance security without an expiration date until the Engineer issues the written release received by the Clerk. Have the accepted instrument matched to that continuing obligation.

Is the maintenance bond the same as the original performance security?

The code calls for maintenance security of 15% of the original guarantee before performance release, for two years after final acceptance. It permits utilities to use suitable annual-guarantee language, but that does not establish that every applicant's purchase combines the two.
