Cresskill, NJ — Street Opening Bond

Cresskill publishes general street-opening security rules alongside separate excavation, utility and maintenance-guarantee provisions. Before applying, ask the Borough Clerk to identify the required instrument for your opening, its size and your applicant category. Do not assume this single purchase application supplies every guarantee described in the code.

What this bond does

Arrange the Borough of Cresskill's accepted street-opening surety for the actual permit, after the required form and applicable guarantees are identified.

Who needs it
The street-opening permit applicant, with owner, performing contractor and public-utility roles distinguished for the Borough.
Who it protects
The published provisions address restoration, maintenance and specified indemnity obligations. The Borough's accepted instrument determines which duties the bond secures.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify the opening size and required guarantees

Chapter 230's general street-opening provision calls for a surety form and amount determined by the Mayor and Council and approved by the Borough Attorney. Chapter 230A separately describes excavation requirements, including a bond of at least $5,000 for non-public-utility applicants when excavations exceed 15 square yards.

Chapter 230A also describes a $5,000 guarantee for all permittees, including public utilities and their contractors, in an acceptable indemnity-bond or bank-draft form. Its public-utility provision separately describes annually renewing indemnity. These are not evidence that a private contractor automatically qualifies for a utility's arrangement.

Have the Clerk and Engineer identify the operative permit conditions, cumulative or alternative guarantees and accepted form. The published chapters have different permit and maintenance periods; no single duration has been assigned here to the offered bond.

Obtain the Borough's requirement before issuance

Prepare the opening address, block and lot, dimensions and drawings, purpose, dates, owner details and contractor/emergency contacts. Obtain the Clerk's actual application and have the Engineer identify the restoration and maintenance requirements for the site.

Purchase Now opens the existing Propeller application, with no fixed sum or term listed. Send the Borough's written request for an instrument match before issuance. Check the principal, Borough recipient, amount, work identification and dates, including any separate maintenance guarantee.

File the issued bond and required permit materials as directed by the Borough. Permit approval, sewer-connection permission where needed and restoration acceptance remain separate. Obtain written release instructions for the accepted guarantee rather than using a period from another chapter as an automatic cancellation date.

Questions about this bond

Is the $5,000 non-utility bond required for every opening?

The Chapter 230A provision applies that particular bond requirement to non-public-utility applicants for excavations over 15 square yards. The chapter separately describes an all-permittee guarantee. Ask the Borough which instruments your opening requires.

Can a contractor use a public utility's annual indemnity?

Not merely because the work involves a utility. The code distinguishes the utility from its contractors and describes separate guarantees. Have the Clerk confirm the actual applicant and accepted arrangement.

Which published maintenance period controls my bond?

Have the Borough specify that in its written permit and bond requirement. Its general street-opening and excavation chapters describe different periods; this purchase listing does not resolve which guarantee and release process applies.
