Elizabeth, NJ — Street Opening Permit Bond

Elizabeth publishes different utility/road-opening applications for private contractors and utility companies. Its private-contractor packet requires original security and calculates it from the opening area or number of soil borings. Have Engineering confirm your applicant category and accepted bond form before purchase; the packet's differing security labels and attached sample need an exact instrument match.

What this bond does

Arrange City of Elizabeth security for the private contractor's permitted utility or road opening, matched to Engineering's current accepted form.

Who needs it
The private contractor applying for the opening, with the property owner, utility company and any approved utility-applicant exception separately identified.
Who it protects
The published opening provisions address restoration and specified City/third-party indemnity obligations. The accepted bond form controls; this is not simply proof of a contractor license.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify who is actually applying

The private-contractor packet requests an original application, insurance certificate and performance bond, along with plans and other required supporting documents. It says the contractor's business address must match across submissions. The application separately labels the security entry as a maintenance bond.

The separate utility-company form includes a City Attorney statement that a utility company applying for its own opening does not need the listed fee, insurance certificate or performance bond. It is a published older form, not proof that a private contractor working for a utility receives the same treatment. Confirm any exception with Engineering.

The private-contractor application shows $1,500 per square yard for an opening or $1,500 per soil boring. Its attached code describes a two-year bond and permits one bond to cover multiple excavations when accepted. Have Engineering confirm the actual calculation, scope and dates rather than treating the figures as a provider's preset option.

Resolve the required instrument before issuance

The packet's checklist and application use different security labels, and its attached sample license-and-permit bond says it is not valid for performance or maintenance bonds. Do not copy that sample's limits or cancellation wording into a purchase request. Obtain Engineering's accepted current instrument and have it matched by the issuer.

Purchase Now opens the existing Propeller application; no fixed sum or term is listed. Confirm the contractor principal, City recipient, approved amount, covered opening or borings and dates before issuance. The utility-company packet is not a substitute for that private-contractor requirement.

The published private-contractor form routes original documents to Public Works/Engineering, Room 304, and requires a final approved permit before work, a permit copy on site and three days' advance notice. Confirm the current filing route with Engineering. Sidewalk permission and relevant connection/backfill inspections remain separate from purchasing the bond.

Sources

Have these ready

  1. Engineering confirmation of private-contractor versus utility-company applicant status.
  2. Contractor legal name and consistent business address, worksite, opening area or boring count and plans.
  3. Accepted current bond instrument resolving the packet's performance/maintenance/sample differences.
  4. Assigned sum and dates, required originals, permit approval and inspection/work-notice instructions.

Questions about this bond

Does utility work mean I can use the utility-company exception?

No automatic exception is established for a private contractor. The separate form's statement concerns a utility company as applicant. Confirm the actual applicant and any waiver with Engineering.

Is security calculated per square foot?

The published private-contractor application uses $1,500 per square yard for openings and $1,500 per soil boring. Have Engineering verify the applicable measurements and assigned total before issuance.

Should I reproduce the packet's sample license-and-permit bond?

Not without confirmation. The packet requires performance/maintenance security, but the sample's legend excludes those bond types. Obtain Engineering's accepted form and have the issuer match it before purchasing.
