What this bond does

The bond serves to protect the Insurance Commissioner of the State of Hawaii and any individuals who may be injured by a breach of the administrator's statutory duties. It acts as a financial safeguard to ensure that TPAs conduct their business affairs according to Hawaii law.

Who needs it
Business entities applying for or renewing a Third Party Administrator license in Hawaii are required to obtain and maintain this surety bond as part of their official state filing process.
Who it protects
This bond provides coverage in favor of the Insurance Commissioner of the State of Hawaii. It creates a right of action for the Commissioner or any injured party to recover damages caused by the TPA's failure to comply with regulatory statutes, limited to the total bond amount.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Bond Amount and Statutory Requirements

Applicants must secure a surety bond of at least $100,000 for initial licensure. Upon renewal, the required bond amount increases to $300,000 as mandated by Act 069, which amends HRS § 431:9J-103.

The bond is continuous in nature. It remains in full force and effect and cannot be canceled or terminated until two years have elapsed from the last day the principal functioned as a TPA, unless prior written consent is provided by the Insurance Commissioner.

Application and Filing Procedures

The surety bond must be submitted as part of a complete TPA application package. The document requires a notarized signature from both the principal and the surety to be considered valid for the Hawaii Insurance Division.

All required documents, including the notarized bond and the completed TPA filing checklist, must be submitted electronically through the NIPR Attachments Warehouse. Incomplete packets will not be processed by the licensing branch.

Ongoing Regulatory Compliance

Beyond the surety bond, TPAs must file annual financial statements certified by an officer of the company. These statements must demonstrate a positive net worth in accordance with Generally Accepted Accounting Principles.

Administrators are also required to file an annual report for the preceding calendar year with the Commissioner by March 1. This report is filed electronically directly with the Insurance Division.
