What this bond does

Idaho's bond provides assurance of the notary's compliance with notarial law. It is submitted to the Secretary of State as part of the commission application.

Who needs it
Idaho notary applicants and renewing notaries arranging commercial surety assurance. State employees whose commission is required for their work should first check the statutory risk-management alternative.
Who it protects
People with claims arising from violations of Idaho notarial law, under the assurance. The surety's liability and any separate E&O policy are different forms of protection.

Your bond option

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Submit the bond with the state application

Idaho Code 51-121 requires $10,000 in surety assurance when you submit the application. It must use the Secretary of State's prescribed form and cover acts during the commission. The Secretary of State's training directs applicants to provide a completed, notarized application with the bond. Complete the provider's process first, then follow the state's submission instructions.

Questions about this bond

How long is an Idaho notary commission?

Idaho Code 51-121 provides for a six-year commission. The bond must cover acts during that commission; check the issued document's dates.

Can I send the bond after the state application?

The statute requires the assurance at the time you submit the application. Arrange the bond before submitting your commission application to the Secretary of State.

Is there an alternative for a state employee?

The statute allows assurance from Idaho's risk management office for a regular state employee whose commission is required for that employment. Check that route with your employer before purchasing a commercial bond.

Does checkout issue my notary commission?

No. RLI handles the bond application. The Secretary of State separately reviews the commission application, and valid assurance must be on file before you perform notarial acts.
