Kansas — Abstracter Bond
Abstracting reports title-record information and is different from insuring title. Kansas ordinarily requires abstracters to file both a bond and an errors-and-omissions policy with the Abstracters’ Board of Examiners before licensing. Use The Southern Agency’s listing with the Board’s actual county-specific instructions; the current accepted ordinary bond condition remains unverified here.

What this bond does
K.S.A. 58-2802 sets a bond amount determined by the Board, with a $25,000 minimum, alongside at least $25,000 of E&O insurance. Those statutory amounts are not a confirmation that this unlabeled option supplies the particular Board-accepted instrument. Extra counties and Board-authorized insurance-unavailability alternatives also affect what should be filed.
- Who needs it
- A person, firm, partnership, association or corporation making, compiling or completing and selling abstracts of Kansas real-estate title. Identify the actual license applicant and each county of business. This is the abstracter’s licensing file, not a property owner’s title-insurance policy.
- Who it protects
- The bond and E&O insurance are separate statutory filings. The precise accepted condition and protected claims for the ordinary Board-required bond have not been established here. The statute describes actual-damage protection for one particular alternative when insurance is unavailable; that alternative must not be represented as the condition of every ordinary bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Questions about this bond
Does one general bond cover work in every Kansas county?
K.S.A. 58-2802(d) requires an additional bond for each county when a licensee does business in more than one county. Follow the Board’s actual execution, approval and filing requirements for the counties involved.
Can I drop E&O after purchasing?
Not under the ordinary statutory route, which requires both the bond and E&O insurance. If insurance is unavailable, the Board may authorize a statutory alternative. Do not treat an exception as self-selected permission to omit the policy.
Is the $25,000 minimum the final amount I should select?
The Board establishes the ordinary bond amount, which cannot be below $25,000. The actual Board requirement and any authorized alternative must be confirmed. This public option does not supply an amount or term label, and its exact accepted condition remains pending.
