Kearny, NJ — Right Of Way Permit Bond

Identify the Kearny permit behind your bond request before proceeding. The Town's street-opening restoration security and its separate right-of-way approval for poles, antennas and cabinets are different requirements.

What this bond does

Match this Kearny right-of-way offering to the Town's written security request and accepted form. For street excavation, the code provides a specific restoration-security calculation; a wireless right-of-way approval should not be treated as the same instrument.

Who needs it
The applicant responsible for a Kearny street opening or other right-of-way activity for which the Town has specifically requested a bond. A public utility's special bond treatment should not be assumed to cover an independent contractor.
Who it protects
Street-opening security supports complete restoration of the affected roadway and the Town's ability to arrange unfinished restoration. The accepted bond determines the undertaking; it is not a general license for all Kearny construction or all utility installations.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Distinguish a street opening from a wireless right-of-way approval

Chapter 23 addresses excavation, street opening and material storage within municipally controlled roads. Applications go to Public Works, Street Division, and must identify the work, location, dimensions, surfaces and restoration plan.

Chapter 39 addresses siting poles, antennas and cabinets in the municipal right-of-way. It has its own application process and expressly preserves the need for other road-opening and construction permits. Its application charges and expense deposits are not evidence of the bond amount for your excavation.

Ask the requesting Town office to identify the permit provision and accepted bond form for this offering before you buy. Where the project affects a Hudson County road, establish the County's requirements as well.

For street excavation, use the Town's approved estimate

Section 23-20.7d sets restoration security at 120% of the estimated proposed work, including complete restoration, as determined by Public Works. The Town's estimate may exceed the applicant's estimate. The code permits a bond or cash security and calls for security at application.

The same provision says security remains in effect for three years after acceptance of final restoration work. That is an acceptance-based obligation, not a statement that the provider sells a fixed three-year term starting on purchase.

For regulated public utilities, § 23-20.7e describes a $10,000 bond in lieu of the security deposit, subject to Town Attorney approval, with the same post-acceptance period. Do not apply that alternative to every private contractor who happens to work on a utility connection.

Match the document before proceeding to the offering

Purchase Now retains the existing Propeller Right of Way Permit Bond destination. Provide the Town's written request, accepted form, responsible applicant, approved amount and site details before proceeding. The broad offering title alone does not establish which Kearny obligation its form satisfies.

For a street opening, prepare the scaled sketch, work and restoration estimate, proposed dates, utility mark-out and insurance information requested by the Town. Submit the issued security through the Town's directed process and obtain the permit before excavation.

Track final restoration acceptance separately from initial permit approval. Ask Public Works how to document the continuing security and obtain release; do not substitute a permit expiration date for the restoration-security period.

Questions about this bond

Is a Kearny Chapter 39 right-of-way permit the same as a street-opening permit?

No. Chapter 39 concerns poles, antennas and cabinets and expressly requires other necessary road-opening and construction approvals.

How is ordinary street-opening restoration security calculated?

Section 23-20.7d uses 120% of the Town-approved estimated work, including complete restoration. Public Works may determine a higher estimate than the applicant supplied.

Can every contractor use the $10,000 utility alternative?

The reviewed provision applies to public utilities regulated by the State. Obtain the Town's decision about the actual applicant rather than extending it to all utility contractors.

Does this option have a confirmed three-year purchase term?

No fixed provider term is published. The code's three-year period runs after acceptance of final restoration; match the issued form and continuing obligation with the Town.
