Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Operational Obligations and Compliance

The primary obligation of the principal is to faithfully perform all duties owed to agricultural producers. This includes the timely payment of gross proceeds from the sale of commodities, minus any lawful charges.

Additionally, the principal must strictly comply with Chapter 21 of Title 3 of the Louisiana Revised Statutes of 1950. This encompasses the obligation to deliver stored agricultural commodities to depositors upon lawful order and the payment of all associated charges.

Claim Procedures and Surety Terms

If a principal fails to meet their obligations, damaged parties or the Louisiana Agricultural Commodities Commission may maintain a suit to recover on the bond. Any written claim for recovery must be filed with either the surety or the obligee within 180 days of the relevant transaction.

The bond proceeds are strictly reserved for settling valid claims and cannot be utilized to cover legal fees, salaries, or representation expenses for either the surety or the principal. Surety cancellation requires a 90-day written notice provided to the obligee.

Bond Maintenance and Duration

The term of the bond is defined by the specific dates established between the principal and the surety. It may be continued on an annual basis through a continuation certificate executed by both parties and filed with the commission.

Acts or omissions committed by authorized agents of the principal are construed as acts of the principal themselves. Consequently, the protection of the bond extends to cover these actions to the same extent as if the principal had performed them personally.
