Minnesota — Utility Contractor (Continuing) Bond

MnDOT's continuing utility bond stays on file for a single company's utility permits within State trunk-highway right of way. Use the continuing form rather than the individual-project form, and obtain the accepted amount: the actual continuing instrument leaves the sum blank.

What this bond does

Secure the specified restoration, State engineering/inspection expense and repair obligations arising from utility work under the covered trunk-highway permits.

Who needs it
Utility owners and contractors matching the company principal to MnDOT permits, not applicants for a generic statewide trade license.
Who it protects
The instrument runs to the State of Minnesota, Commissioner of Transportation. It addresses trunk-highway restoration and the stated State costs/damage, not liability insurance, a DLI contractor credential or automatic payment security for every utility construction contract.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Keep the company's bond and individual permits distinct

MnDOT distinguishes an individual bond for one project from continuing security covering utility permits by one company. Continuing security does not eliminate the required permit application for the actual work.

The utility owner applies for permission; the contractor must carry a copy of the approved permit while working. Check the company principal, accepted sum and covered permit activity with the relevant permit office before applying for the bond.

Read the continuing and cancellation provisions

The form calls itself continuing, not uncancellable. It allows surety cancellation on 30 days' written notice by registered mail to the principal and Commissioner, retains prior accrued liability as stated, and separately permits principal termination by notice to the obligee.

Its two-year suit provision is conditional on the governing statute, ordinance or regulation not specifying a time. Do not turn that clause into a universal deadline or a two-year provider term.

Purchase Now opens Propeller in a new tab. Match the accepted continuing instrument, company, Commissioner recipient, amount and dates before applying. After issuance, check principal/surety execution and file as the permit office directs. Bond payment alone is not an approved utility permit or permission to begin work.

Questions about this bond

Does continuing security replace each utility permit?

No. It covers the stated company's permits, but the actual work still requires MnDOT permission and the approved permit.

What fixed sum appears on the continuing instrument?

None. It has an amount blank; obtain the accepted request from the permit office instead of assuming a generic State contractor bond amount.

Does continuing mean the bond cannot be cancelled?

No. The instrument contains distinct surety-cancellation and principal-termination provisions, retaining described prior liability.
