Montgomery County, MD — Right Of Way Permit Bond

Montgomery County DPS assigns ROW security after reviewing the actual work. Use its ROW calculator and accepted performance template with power of attorney, then complete permit issuance and inspection; do not use demolition/sediment figures or assume a building permit alone covers County ROW damage.

What this bond does

Montgomery County, Maryland DPS performance security for the work described in the actual public ROW permit.

Who needs it
The permit applicant/principal whose legal name and required execution must correspond on the application and bond.
Who it protects
The County template secures performance/correction of the referenced permit work, subject to its conditions and penal sum. It is not a guarantee of payment on every private project or permission for State/municipal roads.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify the ROW work and use DPS's assignment

DPS's current bond instructions direct ROW applicants to its Public Right of Way Bond Calculator. Costs are reviewed/approved through plan review, and a permit technician notifies the applicant of the amount generally after that review. Smaller jobs can have scope-specific flat assignments; do not substitute demolition or sediment-control figures from the same page.

If DPS requires Restoration of ROW because on-site construction may damage County infrastructure, that permission supplements a parent building/construction permit. The process calls for a site plan or survey showing the work and affected ROW, with roadside-tree information/protection where applicable. State or municipal roads require their own jurisdiction's permission.

Use the standard form and keep issuance separate

Purchase Now opens Propeller; the option displays no fixed amount or term. Match DPS's assigned sum, County recipient, applicant/principal, ROW permit/track reference, work and dates with the issuer. DPS requires its performance template and power of attorney; changes to the form need County Attorney approval.

The template requires the application and bond names to correspond. Arrange DPS-accepted signatures, seals and any corporate attestation with the issuer; obtain confirmation of the required authorized signer rather than rewriting the form. Post accepted security and satisfy the other permit requirements before DPS issues permission.

For Restoration of ROW, use the electronic application process, arrange the required post-issuance pre-construction meeting with the assigned inspector and obtain final inspection/approval. That starts the bond-release and administrative-closeout process. Get the actual continuation/release instructions rather than assuming same-day release, a fixed annual term or automatic cancellation when work stops.
