New Hampshire — DOT Right Of Way Permit Bond

NHDOT now calls its excavation-permit process Right of Way Activities. It covers disturbance of State-highway shoulders, ditches, embankments or pavement, and work within limited-access divided-highway ROW. Match the bond request to that activity and the responsible NHDOT office; utility work has additional published surety requirements.

What this bond does

Provide the security NHDOT requests for the applicant's identified right-of-way activity, using the accepted project or continuing instrument.

Who needs it
The applicant responsible for the proposed State-highway ROW work, with the utility owner and performing contractor identified where applicable.
Who it protects
The relevant security supports the permit provisions and the permitted work/restoration undertaking. This offering should not be treated as a general contractor-license bond or as permission to begin field work.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Use the correct NHDOT permit category

The current NHDOT permit page labels the process Right of Way Activities, formerly Excavation Permits, and directs applicants to the NH Permit Portal. Its driveway and utility-pole processes are separate categories; do not select a bond by the word excavation alone.

Identify the State route, municipality, exact location and whether the work disturbs pavement, shoulder, ditch or embankment. For limited-access divided highways, NHDOT's ROW category applies to any work within that right-of-way. Ask the office handling the application to identify the required security and instrument.

Confirm project versus continuing security before issuance

The August 2025 Utility Accommodation Manual requires a continuing surety bond before field installation activity under its ROW procedure. Its appendix lists single-project and multiple-project/long-term examples. These utility instructions do not establish one amount or term for every non-utility ROW activity.

Purchase Now keeps the existing Propeller application, whose option supplies no fixed amount or term. The accepted form and the match between this broad offering and NHDOT's project or continuing requirement still need confirmation. Give the issuer the office's written request, principal, project identification and required dates.

After issuance, file the bond as the responsible NHDOT office directs and obtain the actual permit. Complete required pre-work coordination and any directed conference before starting. Keep the issued permit, construction conditions and final acceptance separate from the bond purchase.

Questions about this bond

Is the old excavation-permit name still the current category?

NHDOT's current page calls it Right of Way Activities and notes that it was formerly Excavation Permits. Use the current category and office instructions.

Does the utility manual set the terms for every ROW bond?

No. The manual addresses utility and railroad accommodation. Confirm its applicability and the accepted instrument for your particular activity, especially non-utility work.

Does this purchase option already include NHDOT's amount and duration?

No fixed amount or term is listed. Obtain the responsible office's requirement and have the provider confirm the correct project or continuing form before issuance.
