Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Establishing a Remediation Funding Source

Owners and operators subject to the Industrial Site Recovery Act (ISRA) must establish an RFS prior to the transfer of property or within 14 days of submitting a certified remedial action workplan. Parties operating under a Spill Act directive, Administrative Consent Order, or Direct Oversight must also comply with these requirements as instructed by the Department.

The RFS amount must be equal to or greater than a detailed cost estimate covering remediation, DEP oversight fees, and the maintenance of engineering controls. The Department provides a checklist and spreadsheet worksheet to assist in calculating these totals. A 1% surcharge applies annually, except when a self-guarantee is utilized.

Exemptions and Guidance

Specific entities, including government bodies, schools, child care centers, and those conducting remediation in designated Environmental Opportunity Zones, may qualify for exemptions from RFS requirements. Eligibility criteria and application processes for these exemptions are detailed in the Department's RFS Exemption Guidance Document.

For technical assistance, the NJDEP offers a dedicated guide and FAQ documents. Inquiries may be directed to the Remediation Funding Source Coordinator via the FMS Duty Officer at 609-940-4405 or through email at Rfsgq@Dep.Nj.gov.
