New Jersey — Highway Access Permit Maintenance Bond

Use the New Jersey highway access maintenance offering for the maintenance stage NJDOT requires, not as a substitute for initial restoration security. The relevant acceptance date depends on whether the project is governed by a developer agreement.

What this bond does

Provide NJDOT-accepted maintenance security associated with a State highway access permit. Match the permit, responsible lot or site owner, required instrument and acceptance-based maintenance period before ordering.

Who needs it
A lot or site owner arranging the maintenance guarantee required by NJDOT's highway access process, or a representative acting for that owner. Do not assume the excavation contractor is automatically the required principal.
Who it protects
The maintenance guarantee concerns the accepted highway-access work and disturbed area during the required maintenance stage. It is distinct from restoration, performance and payment guarantees and does not authorize new construction or use of an unaccepted access.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify maintenance security in the permit conditions

NJDOT's posted State Highway Access Management Code courtesy copy distinguishes restoration and maintenance guarantees in § 16:47-10.4. The Department determines an amount sufficient for the applicable work and disturbed area; it is not a universal fixed amount on this offering.

A developer agreement can require performance, payment and maintenance security as separate obligations. Obtain the Department's actual maintenance request and accepted form rather than submitting a restoration or general performance bond simply because all relate to the same project.

Use the correct acceptance date for the maintenance period

Under § 16:47-10.9f, maintenance guarantees are released one year after construction acceptance and on the lot or site owner's written request. Restoration guarantees have a different release point: construction acceptance plus the owner's written request.

For work governed by a developer agreement, § 16:47-10.9g ties the maintenance guarantee's release to one year after the certificate of final acceptance, again on written request. Construction acceptance and final acceptance should not be treated as the same event.

Keep the applicable certificate and required maintenance document together. The one-year release provisions do not establish a fixed one-year provider term beginning when you buy this option, and passage of time alone does not complete the written-request requirement.

Confirm the owner, permit and accepted maintenance document

Have the State highway, project location, access-permit reference, responsible owner, approved amount and relevant acceptance certificate ready. Ask the assigned NJDOT permit unit which form, dates and filing method it requires.

NJDOT announced that new Major Access Permit submissions move to its digital process beginning July 30, 2026, while existing paper applications already under review continue in that process. Confirm the route for your case and for the issued maintenance instrument; do not assume the announcement approves every bond-delivery format.

Issue and file maintenance security without confusing work permission

Purchase Now retains the existing Propeller Highway Access Permit Maintenance Bond destination. Match the Department's required maintenance undertaking and owner wording before proceeding; this option does not publish a fixed sum or term.

Submit the issued security to the assigned unit as instructed and retain evidence of acceptance. A maintenance bond does not itself issue the access permit, approve construction plans or authorize use of the new access. The code separately requires Department acceptance or specific approval before State highway access is used.

At the end of the applicable maintenance period, follow the Department's written release process. Do not use a municipal occupancy approval or an initial permit date in place of the NJDOT acceptance milestone.

Sources

Have these ready

  1. Confirm NJDOT requested maintenance security for the State highway access permit.
  2. Identify the responsible lot or site owner and required principal wording.
  3. Obtain the accepted maintenance form and Department-approved amount.
  4. Determine whether construction acceptance or developer-agreement final acceptance governs the maintenance milestone.
  5. Confirm the current case and issued-bond filing route with the assigned permit unit.
  6. Retain the certificate, filed bond and instructions for the owner's eventual written release request.

Questions about this bond

Is maintenance security the same as the highway access restoration bond?

No. The code distinguishes those guarantees and their release points. Use the maintenance instrument requested for your permit rather than substituting the initial restoration undertaking.

When does the code's maintenance release period run?

Section 16:47-10.9f uses one year after construction acceptance; subsection g uses one year after final acceptance for the developer-agreement maintenance guarantee. Both require the owner's written request.

Does that mean this purchase has a one-year term from today?

No. The retained option publishes no fixed term, and the code's release provisions are tied to Department acceptance milestones. Match the issued undertaking to the actual permit conditions.

Can the maintenance bond authorize use of the highway access?

No. NJDOT's acceptance or specific approval to use the access is a separate requirement. Municipal occupancy approval does not replace the State's decision.

Does the digital transition mean every issued bond can be filed the same way?

That is not established. The announcement concerns new Major Access Permit submissions; confirm the accepted delivery method for your case and actual maintenance document.
