New Mexico — Consumer Protection (Installer Or Repairman) Bond

New Mexico's manufactured housing installers and repairmen must maintain consumer protection security with the Manufactured Housing Division. Match the bond to that license and work, rather than treating the catalog name as a requirement for every repair business.

What this bond does

Provide the manufactured housing installer or repairman's consumer protection security required by 14.12.4.13NMAC.

Who needs it
New Mexico manufactured housing installer and repairman applicants and licensees, including covered out-of-state operators.
Who it protects
The installer/repairman rule protects consumers against loss from contract fraud, misrepresentation or false promises, and violation of the licensee's written warranty. General bond rules limit payments to actual consumer damages and exclude punitive damages, attorney fees and pain-and-suffering costs.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

Rule14.12.4.13 sets a minimum of $10,000 and requires presentation at the license application and each renewal. The Division prescribes the accepted form and amount; after violations, the general rules permit an installer or repairman's required security to increase up to $25,000. Out-of-state operators must also supply the required consent to New Mexico service of process. Dealer and manufacturer security should not be substituted for this license class.

Consumer claims follow the Division's complaint and committee process, not an automatic payment for any unhappy customer. Rule14.12.4.10 addresses aggregate proceeds, possible pro-rata distribution and the security in effect when the relevant sale or service occurred. Cancellation requires sixty days' prior written notice and Division approval; release is not simply automatic when work stops. These claim and release provisions are not selectable product terms.

Purchase Now opens Propeller's New Mexico Consumer Protection Installer or Repairman application in a new tab. Bring the MHD legal licensee and class, current request, accepted instrument, required sum and renewal dates. Match these before paying. Arrange execution and accepted presentation to the Division, confirm how the bond is recorded with the licensing paperwork processed by PSI, retain acceptance and complete the separate license or renewal. RLD continues permitting and inspections; buying security does not authorize installation or replace those steps.

  4. Coordinate bond presentation with PSI-processed licensing and retain Division acceptance.

Questions about this bond

Is this an electronics or general repair-shop bond?

The verified requirement here concerns installers and repairmen of manufactured homes under the Manufactured Housing Division's rules. Do not apply its terms to an unrelated repair business.

Is the amount always $10,000?

That is the minimum under Rule14.12.4.13. The Division prescribes the amount and can require increased installer or repairman security after violations under the general bond rule.

Does every warranty complaint receive a bond payment?

No. A written-warranty violation is a specified basis for consumer protection, but the complaint, findings, actual loss and applicable bond limits still matter. The bond is not an unconditional replacement warranty.

Can the surety cancel as soon as I stop working?

The rules require sixty days' prior written notice and Division approval of cancellation. Release also depends on unresolved claims and the rule's post-business period; stopping work alone does not release the security.
