What this bond does

MSD’s bond form secures the owner/applicant’s performance of the excavation and fill permit conditions for work over an existing sewer. It describes a guarantee that the work will not damage the sewer for one year after completion.

Who needs it
The owner/applicant identified on an MSD excavation and fill permit. The permit bond does not replace a sewer tapper’s separate licensing and bonding requirements.
Who it protects
The form names the City of Cincinnati and/or the Board of County Commissioners, Hamilton County, Ohio as obligee. The protected obligation concerns performance of the permit conditions and the existing sewer, not the applicant’s equipment or general business losses.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

The amount combines work costs and sewer risk

MSD’s permit form identifies the estimated cost of adjustments, relocations or other system modifications and MSD’s estimate of potential sewer damage. It requires a bond for their combined sum before the permit is released.

The permit also allows MSD to increase the bond if additional modifications or risk arise during the work. Use the district-assigned amount and approved plans rather than choosing a standard statewide excavation limit.

Keep the bond and permit documents together

The official bond refers to the permit attached as Appendix 1. It includes owner/applicant and surety signature blocks and approval as to form by the Assistant City Solicitor. It calls for an Ohio insurance superintendent certificate of compliance and evidence of authority when execution is by an agent or attorney-in-fact.

Purchase Now opens Propeller's application in a new tab. Use the owner/applicant, assigned amount and permit details there. After issuance, submit the completed bond to MSD with the requested permit documentation. Use the obligee wording in the district's form and instructions rather than substituting the district's abbreviated name.

Completion does not automatically release the bond

The permit calls for notice to MSD at least 24 hours before work is ready for inspection. Adjustments to the existing sanitary or combined sewer system must be done by an MSD-registered licensed and bonded sewer tapper and remain uncovered until inspection and approval.

Unless otherwise directed, the permit requires a television inspection of the impacted sewers one year after excavation/fill completion before bond release. MSD must be notified that work is complete to begin that waiting period. Keep completion and inspection records; do not treat a purchase date or the last day of earthwork as an automatic release.

Questions about this bond

Is this the same bond as an MSD sewer tapper license bond?

No. This bond names the excavation/fill owner-applicant and secures that permit. The permit separately requires an appropriately licensed and bonded sewer tapper for specified sewer modifications.

Who determines the amount?

MSD’s permit combines estimated modification costs with its estimate of potential sewer damage. Use the amount assigned for the project; the form allows increases for additional work or risk.

Can the permit be released before the bond is submitted?

The official permit states that the bond for the combined sum must be submitted to MSD before release of the permit.

When can the bond be released?

Follow MSD’s permit conditions. Unless otherwise directed, they include completion notice and a television inspection one year after excavation/fill completion before release. Completion alone is not an automatic release.
