What this bond does

Provide PennDOT-approved individual Highway Restoration and Maintenance Bond security under Chapter 459.

Who needs it
Highway-occupancy permittees whose state-highway work requires individual restoration and maintenance security.
Who it protects
M-945K secures compliance with the covered permit and Chapter 459 and protects the Commonwealth of Pennsylvania, Department of Transportation, against covered work-related loss. It is distinct from the Chapter 441 access-obligation form.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Select individual rather than blanket security

M-945K has separate individual and blanket selections. Its individual agreement is assigned by the District Office; blanket security is assigned through the Central Office and has a stated $500,000 minimum.

This offering is labeled Individual Permit. Obtain the District’s required amount and permit/application references rather than using the blanket minimum or assuming ongoing statewide coverage.

Account for work and acknowledged completion

Section 459.5 lets PennDOT require security for substantial right-of-way work in a form and amount it accepts. The regulation describes maintenance protection for at least two years after acknowledged completion; the form also addresses the period while work is performed.

A permit extension requires corresponding extensions of required security. The option does not state a fixed 12-month term. Review the actual dates, future-liability notice provisions, written permission and surviving obligations before assuming the bond can be cancelled.

Prepare the permittee’s executed instrument

Confirm the principal-permittee, Department recipient, agreement/application numbers, sum and effective date. The form permits the contractor to be included with the permittee as a principal; do not replace the permittee automatically.

Follow the form’s execution requirements, including applicable signature authorization and dated surety power of attorney. Compare the request with the provider application before purchase, submit the issued bond as directed and obtain the separate HOP authorization before work.

Questions about this bond

Must an individual-permit bond be $500,000?

That minimum is printed for the blanket selection. The District must establish the amount for your individual instrument.

Is this the M-950K access-obligation bond?

No. M-945K concerns Chapter 459 restoration and maintenance; PennDOT separately identifies M-950K for access obligations.

Does extending the permit leave security unchanged?

The regulation requires corresponding extensions of required bond, insurance or other security. Coordinate the dates with the District and provider.
