What this bond does

Provide the Town's required security for opening, excavating, or disturbing its public right-of-way. The accepted bond must match the particular permit and applicant; a street-opening listing does not establish one amount for every job.

Who needs it
Persons, firms, corporations, and utility companies arranging work in the Town of Phillipsburg's streets or right-of-way. The Department of Public Works receives and reviews the permit application.
Who it protects
The street-opening surety provisions address compliance with the Town's article and loss, liability, or damage connected with making, guarding, or constructing the opening. Maintenance security is separately addressed and should not be assumed to expire when excavation ends.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Opening size and utility status change the requirement

For openings greater than 150 square feet, Section 545-26C specifies a $3,000 surety bond covering the stated opening and future openings in the calendar year. Section 545-26D separately requires utility companies to post a $10,000 continuous renewable surety bond.

The code treats openings of 150 square feet or less separately. Do not apply the larger-opening amount automatically to a smaller job, or assume that a smaller job has no maintenance-security requirement. Ask Public Works to identify the applicable form and arrangement.

Maintenance responsibility outlasts the opening

Section 545-27B provides for a maintenance bond in an amount set by Public Works or its designee, ordinarily for two years. For newly paved streets, it specifies the longer of the five-year moratorium period or the two-year maintenance period.

The article separately describes five-year site-maintenance responsibility after final paving and approval. These are different provisions, not a promise that all obligations end after two years. Confirm the required security dates and any longer protected-pavement conditions with Public Works.

Use the Town's instructions before ordering

Obtain the current Public Works application and required drawings showing the location, existing facilities, proposed work, and disturbed area per road, including trenchless disturbance. Confirm the bond wording, applicant, amount, and whether separate maintenance security is needed before using Propeller.

File the issued bond as Public Works directs and obtain the permit before starting. The article requires completion within 90 days of permit issuance, subject to its extension process; that permit period is not the bond term. Final acceptance and release must be in writing from Public Works, rather than assumed from completion or the passage of time.

Sources

Have these ready

  1. Calculate the proposed disturbance area per road and identify trenchless work.
  2. Identify whether the applicant is a utility company and whether the street is within its paving moratorium.
  3. Obtain Public Works' current application, bond instructions, maintenance amount, and required dates.
  4. Prepare the drawings, insurance documentation, work schedule, and permit submission.

Questions about this bond

Does the $3,000 provision apply at exactly 150 square feet?

Section 545-26C is for openings greater than 150 square feet. The code has a separate category for 150 square feet or less; ask Public Works what security your smaller opening requires.

Is the utility-company bond the same as the larger-opening bond?

The code states a separate $10,000 continuous renewable surety requirement for utility companies. Confirm the applicable arrangement instead of automatically treating it as the $3,000 calendar-year provision.

Will the bond be released as soon as the road is restored?

No automatic release is established. The Town requires written final acceptance and release, and separate maintenance and protected-pavement conditions can continue after restoration. Obtain Public Works' instructions for your permit.
