What this bond does

Provide Stroudsburg Borough’s accepted street-opening maintenance, indemnity or performance security for the applicable permit.

Who needs it
Applicants opening or excavating borough streets, including independent authorities and public utilities with underground facilities.
Who it protects
The accepted condition protects the borough against covered losses and secures opening specifications, restoration or continuing maintenance. The code does not treat a cash deposit, insurance and bond as one interchangeable item.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Confirm who performs final restoration

Section 21-106 describes indemnity and maintenance security related to restoration costs, with a $1,000 minimum. When the borough does not restore the opening, it requires acceptable performance security equal to 100% of the estimated restoration cost.

Ask the Borough Manager which condition or combination is required and how the restoration estimate is determined. Do not apply the $1,000 minimum as the complete requirement for every applicant-performed restoration.

Identify the utility arrangement correctly

Independent operating municipal authorities and public utilities owning underground facilities may post a yearly bond of at least $25,000, as determined by the Manager or Council, for permits in their own name.

That arrangement differs from the code’s exception for utilities owned or operated by the borough. Independent authorities are not included in that exception. Confirm the applicant entity and approved arrangement rather than assuming all utility work is exempt.

Keep permit, restoration and discharge distinct

Prepare the work plan and Pennsylvania One Call reference, then match the borough’s condition, principal, sum and dates with the provider before purchase. File the issued security, separate insurance and any required deposit and obtain permission before ordinary work.

The code ties relevant security to a certificate of final inspection, not merely visible completion. Confirm the applicable maintenance period and closeout procedure; the option states no fixed term, and a yearly arrangement does not automatically remove continuing restoration responsibility.

Questions about this bond

Is $1,000 enough for every opening?

No. It is a stated minimum in the maintenance/indemnity provision. Applicant-restored work has a separate estimated-cost performance requirement.

Are independent authorities exempt like borough-owned utilities?

No. The borough-owned/operated exception expressly excludes independent operating authorities; a qualifying authority may instead use approved yearly security.

Does completion alone discharge the bond?

The relevant code provisions tie termination to a certificate of final inspection. Obtain the actual condition and borough closeout instructions.
