What this bond does

This bond protects health spa members by providing a source of recovery if a member suffers an actual financial loss due to the closure of a health spa. Financial loss is strictly limited to the unused or unearned portion of a member’s prepaid dues or fees.

Who needs it
Anytime Fitness franchisees and other health spa operators required to register with the Texas Secretary of State and electing to provide security through a surety bond rather than an exemption.
Who it protects
The bond serves as a financial guarantee for the benefit of the State of Texas and individual members. It specifically covers claims where a final administrative order from the Secretary of State determines a member has suffered a financial loss resulting from the closure of the facility.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Understanding the Security Requirement

The amount of the surety bond required for registration is determined by the total dollar amount collected for prepaid memberships at the specific location. Bond amounts range from $20,000 to $50,000 depending on your facility's prepaid membership volume.

The bond is continuous until cancelled, requiring the surety to provide at least 60 days' written notice to the Secretary of State for cancellation. Coverage remains in effect until two years after the health spa ceases business or all claims are satisfied.

Operational Compliance and Liability

By maintaining this bond, the health spa principal agrees to fulfill all duties and responsibilities under the Texas Health Spa Act. The surety's aggregate liability is capped at the bond amount, meaning total claims exceeding this amount are distributed on a pro rata basis.

Liability is not cumulative; the bond limit remains static regardless of the number of years the bond is in force or premiums paid. The surety is only liable for claims brought within two years of the bond's last effective date.

Filing and Registration

Applicants must ensure the bond principal name matches their official certificate of registration application. The bond must be signed by authorized representatives of both the health spa and the surety company, which must be authorized to conduct business in Texas.

Completed filings should be delivered to the Registrations Unit in Austin, Texas, via mail or in-person delivery to the James Earl Rudder Office Building. No filing fee is charged by the state for this submission.

Questions about this bond

What happens if total member claims exceed my bond amount?

If claims exceed the total bond amount, the surety will pay the full bond amount to the Secretary of State for pro rata distribution to the claimants.

Does this bond protect against all types of health club disputes?

No. Coverage is strictly limited to actual financial loss, defined as the unused or unearned portion of a member's dues or fees resulting specifically from the closure of the health spa.

Can I switch from a bond to another form of security later?

The statute requires proof of security as part of the initial registration process. You should contact the Texas Secretary of State’s Registrations Unit to discuss changes to your security filing status.

No. The required security amount scales based on the total prepaid membership revenue, starting at $20,000 for up to $20,000 in prepaid dues and reaching $50,000 for revenue over $45,000.
