Texas — Plaintiff's Garnishment Bond

Use the Texas court's actual prejudgment garnishment security order. Rule 658a specifies a defendant payee and court-fixed sum; it does not make twice the plaintiff's entire debt the starting amount for every application.

What this bond does

Provide the plaintiff security required before final judgment for the actual garnishment writ and accepted execution.

Who needs it
The party applying for prejudgment garnishment and advisers preparing that file.
Who it protects
The rule addresses prosecution of the suit and adjudged damages or costs for wrongfully obtaining garnishment, within the security penalty. It does not guarantee payment by the garnishee or successful collection.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Use the ordered amount, not an automatic double-debt formula

Rule 658a's issuance requirement is before final judgment. File with the officer authorized to issue the writ using the court-ordered sum, defendant payee and sufficient surety. Have the actual stage and request confirmed instead of assuming this rule imposes the same security after judgment.

The rule permits noticed review of amount or surety sufficiency. Its later reduction provision depends on the garnishee's answer, notice and hearing, using the stated indebtedness and effects. It is not permission to set a reduced starting sum yourself.

Purchase Now opens Propeller. Confirm plaintiff, defendant, garnishee, case, current order and accepted condition before applying. Follow filing directions for the executed instrument; purchase itself neither issues the writ nor establishes the garnishee's debt.

Questions about this bond

Should I automatically double the full debt?

Rule 658a starts with the court-ordered amount. Its later reduction provision has specific answer, notice and hearing conditions; do not use it as a self-calculated starting limit.

Does the stated rule apply identically after judgment?

Its security-before-issuance language is expressly before final judgment. Bring the actual case stage and requirement for confirmation.

Does application prove that the garnishee owes money?

No. The security application does not establish the garnishee's indebtedness or decide the underlying claim.
