What this bond does

Helps a highway-encroachment applicant prepare SM-6 execution, permit application and restoration obligations for the responsible DOH district.

Who needs it
Applicants installing or working along West Virginia state highways under a DOH encroachment request.
Who it protects
SM-6 names the State of West Virginia and secures repair or payment for damage to highways, bridges, shoulders and ditches, inspection costs, permit compliance and protection of DOH and the state from losses caused by the work or repairs.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify the district and proposed installation

The official permit page directs applicants to check with the district before building state-highway access. Permits depend on the actual location, design and DOH requirements; a bond purchase is not approval of a driveway or other encroachment.

The page offers the WVDOT Permit Portal and MM-109 paper application. For paper submission, it instructs delivery of the signed application with plans/drawings/specifications to the District/County Permit Office where the work will occur. Confirm the actual submission route and whether security is required.

Prepare the requested SM-6 instrument

Get the approved amount, legal principal, installation description and applicable permit details from DOH. SM-6 leaves the sum blank; this Propeller option supplies no independently verified amount or period.

The current instructions call for the two-page bond: applicant/surety signatures on page one, notarized acknowledgments on page two and accompanying Power of Attorney. The form affirms its text is a verbatim reproduction of SM-6, so resolve any proposed wording change with DOH and the provider rather than improvising it.

Follow district acceptance and restoration directions

Use the existing Propeller application with the requested SM-6 form, then file the executed instrument as the permit office directs and obtain permit authorization before work.

SM-6 requires damage repair to the condition determined by the responsible District Engineer, or sufficient payment for restoration, plus DOH inspection costs and permit compliance. Confirm inspection acceptance and actual discharge with that office. No fixed annual expiry or cancellation-notice period should be invented from the form's execution date.

Questions about this bond

What amount does SM-6 require?

The published form leaves the sum blank. Get DOH's required amount for the actual installation; this option records no verified amount.

Where does a paper permit application go?

The official page directs the signed MM-109 with plans/drawings/specifications to the District/County Permit Office where work will occur. It also offers an electronic portal.

Does the bond need notarization and Power of Attorney?

The current instructions require applicant/surety signatures on page one, notarized acknowledgments on page two and accompanying Power of Attorney.

Is this a guarantee of every contractor project?

No. SM-6 concerns the permitted highway installation, damage repair/restoration, inspection costs and related permit compliance, not every unrelated construction contract.
