What this bond does

This bond concerns the representative's duties administering a deceased person's estate. It is different from a conservator's bond for a living person's property.

Who needs it
The representative required to give security for the decedent's estate. Use the legal applicant and capacity identified in the estate proceeding.
Who it protects
The bond secures the estate-administration obligation stated in its conditions for those entitled to its protection. It does not grant authority beyond the representative's appointment.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Use the amount directed for the estate being administered

West Virginia Code section 44-1-7 ties a required executor or administrator bond to the estate being administered and addresses additional security if the amount proves insufficient. It also accounts for certain will-authorized real-estate powers.

Have the county commission or clerk's direction available instead of calculating the amount from one account balance. Identify which property the appointment covers and ask the estate adviser to resolve any discrepancy before completing the application.

Sources

Have these ready

  1. Have the decedent's full name, county and estate case or reference number ready.
  2. Use the executor's or administrator's legal name and exact appointed capacity.
  3. Gather the required sum, bond instructions and any requested form; available estate and relevant real-property information may help answer the application.
  4. After issuance, complete execution and delivery using the commission or clerk's instructions. Applying does not finish the estate appointment.

Questions about this bond

Is this the bond for an estate administrator?

This offering identifies an administrator, executor or personal representative of a deceased person. A living person's conservator or guardian uses a different appointment and bond request.

Can the estate's real property affect the bond direction?

Section 44-1-7 addresses situations in which a will authorizes sale of real estate or receipt of its rents and profits. Use the official direction for this estate rather than assuming personal property is the only relevant information.

What if the estate's required security changes?

Section 44-1-7 provides for new or additional bond when the appraisement shows insufficient security. Follow the commission or clerk's direction; an existing bond does not automatically update itself.

What happens after I select Purchase Now?

RLI opens in a new tab through The Southern Agency. Complete its application and review process before issuance, then follow the estate proceeding's separate execution, filing and acceptance instructions.
