What this bond does

The form requires the principal to excavate and restore the public place in compliance with the city's Street Excavation Ordinance, pay city costs incurred in performing work for the principal, and protect the city against incomplete or defective materials and workmanship for the stated period.

Who needs it
The contractor or principal excavating, or about to excavate, a public place within the City of Albuquerque.
Who it protects
The City of Albuquerque is the obligee. This public-place restoration security is different from a general contractor license or liability policy and from the city's separate sidewalk, curb and gutter bond.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

City acceptance matters to the workmanship period

The bond's incomplete/defective materials and workmanship provision runs for one year from the city's acceptance of the work. That is not one year from applying for the bond, and it should not be reduced to a guessed annual checkout term.

The currently linked form bears a 2001 revision date. Obtain the city's current request before using it for your project. Its execution instructions include entity-appropriate acknowledgments and an attached surety power of attorney. Complete those steps after issuance, then submit the bond with the permit materials required by Construction Services.

Sources

Have these ready

  1. Have the public-place excavation location, work description and ROW permit reference.
  2. Use the contractor's exact legal name and the city's recipient wording.
  3. Confirm the current accepted excavation bond form and required sum.
  4. Keep construction acceptance records and post-issuance acknowledgment instructions with the permit file.

Questions about this bond

Can I use the sidewalk, curb and gutter bond instead?

The city lists that as a separate form. This excavation form secures public-place excavation and restoration; use the instrument requested for the actual work.

Does the bond application arrange barricades or issue the ROW permit?

No. Albuquerque administers excavation/barricade permits and traffic requirements separately. Starting the bond application does not approve a closure or authorize excavation.

What happens after Purchase Now?

Propeller opens in a new tab for the application. Check the principal, City of Albuquerque obligee, accepted form and sum. Issuance comes later; execute the issued document and deliver it under the city's instructions for the permit.
