Baltimore, MD — Stormwater Management Performance Bond

Baltimore City's stormwater code links a performance bond to the inspection and maintenance agreement for a required private stormwater facility. This is not simply an excavation-completion guarantee or a promise that security ends when a building opens.

What this bond does

Article 7, §27-3 requires the owner to execute an inspection and maintenance agreement before a grading or building permit can be issued for a project requiring a private stormwater management facility. The section also requires a performance bond with amount, terms and provisions acceptable to the Department.

Who needs it
The owner responsible for the private facility and the agreement. The agreement binds current and subsequent owners of the land served, but that does not by itself establish how a surety bond is amended or replaced after a transfer. Match the principal and legal recipient to the Department's accepted documents.
Who it protects
The agreement provides reasonable-time access for departmental inspections to ensure the facility works to design standards. It must provide for bond forfeiture if the owner fails to correct notified plan nonconformance within the specified reasonable period. General liability coverage and a separate street-excavation bond are not substitutes for this facility-maintenance security.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Use the maintenance agreement and recorded project documents

Section 27-3 requires the owner to record the agreement in Baltimore City's land records. Have that agreement, the facility/project identification and the Department's security instructions ready; the section leaves the bond's amount and terms to departmental acceptance rather than prescribing a universal sum.

After written notice of nonconformance, the agreement's correction period must be reasonable and no more than 30 days unless extended for good cause. That is not a 30-day issuance promise, automatic cancellation period or bond term. Obtain the accepted undertaking's continuation and release requirements separately.

Questions about this bond

Is this a Baltimore County requirement?

The section reviewed is Baltimore City Code Article 7, §27-3. Do not apply it to a county request or substitute another authority's form.

Does completion of construction automatically end this bond?

The cited provision concerns the private facility's inspection and maintenance agreement. It does not give an automatic construction-completion release; use the Department's accepted security terms.
