Battle Ground, WA — Right Of Way Permit Bond

Battle Ground's current ROW code requires security of $5,000 or 125% of construction cost, whichever is greater, unless an applicable exception or city waiver applies. A separate annual route is available to qualifying franchisees; it does not give every contractor unlimited blanket coverage.

What this bond does

Secures restoration and the required warranty for covered construction, alteration, repair or other work in Battle Ground ROW.

Who needs it
Permit applicants, contractors and qualifying utility franchisees arranging Battle Ground ROW security.
Who it protects
The security is payable to the city and must satisfy the city attorney in form and substance. It covers the defined ROW restoration undertaking, distinct from the separately required insurance.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Confirm project security or the qualifying annual route

Section 12.118.110 uses the greater of $5,000 and 125% of construction costs. The city engineer may waive surety where there is no risk to city ROW. An owner personally repairing an abutting sidewalk or planter without engaging another has a specific bond exception; hiring a contractor changes that condition.

Current section 12.118.025 allows a qualifying city franchisee to negotiate annual security. Simultaneously active work cannot exceed covered capacity; completed work must be city-accepted before capacity is reused, and additional capacity may require an accepted rider.

Keep security beyond permit expiration when required

The code requires restoration to city details and construction standards and a two-year warranty after work completion. Security remains valid until all guaranteed work is complete and accepted and the city releases it in writing, regardless of permit status.

Identify the work, approved cost, principal and exact city-accepted form. A permit expiring or one job being completed does not itself establish release of the restoration/warranty undertaking.

Complete city acceptance and the start notice

Use the existing Propeller Purchase Now option after confirming the city instrument and amount. Submit the executed security before permit issuance and provide the required plans, applicant details, separate insurance and traffic review.

The current code requires notice to Public Works no later than 8:30 a.m. two business days before permit work starts. Obtain the issued permit and any cut/closure approvals separately, and arrange inspections and documented written release.

Sources

Have these ready

  1. Identify the applicant, location, work, cost and permit.
  2. Confirm project versus qualifying-franchise annual scope and any actual exception/waiver.
  3. Obtain city-accepted form/amount, then arrange security, plans, traffic review and insurance.
  4. Complete permit issuance, required advance start notice, inspections, warranty and written release.
