Birmingham, MI — Right Of Way Bond

Birmingham, Michigan publishes different security provisions for utility ROW work and water/sewer trench work. Ask Engineering which instrument applies and whether a purchased surety bond is acceptable; the City's charged, refundable trench security is not automatically the same as this option.

What this bond does

City of Birmingham, Michigan security assigned to the identified right-of-way permit, subject to confirmation of the accepted surety versus City-held security arrangement.

Who needs it
The actual applicant and performing contractor for the identified utility or water/sewer work, with any required owner and geotechnical-inspector information.
Who it protects
The accepted instrument concerns the City's public-way obligations. It should not be described as the homeowner's private sewer warranty or permission to perform all work on private property.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify utility work versus water/sewer trench security

The separately linked Utility Right-of-Way application lists a $2,500 minimum subject to Engineering's final determination, $5,000 for sidewalk removal/replacement in the Birmingham Shopping District and $10,000 for street or alley pavement removal/replacement. Those entries must be matched to the actual work; they do not establish a universal citywide amount.

The selected July 2026 water/sewer packet instead uses $3,500/$7,000 trench-maintenance security and describes refunds after accepted permanent repairs. Have Engineering identify which amount and instrument apply, whether cash or a purchased surety is required or acceptable, and whether any separate deposit remains due. Do not treat the two documents as interchangeable security choices.

Obtain the actual permit and repair acceptance

The July 2026 ROW application normally expires 15 days after issuance unless otherwise noted. That is the permit's work window, not a supplied bond term. The City separately lists obstruction, sidewalk/approach, utility and water/sewer applications, so confirm the permissions for your actual activity.

Purchase Now opens Propeller. The option displays no fixed amount or term. Once Engineering confirms an acceptable surety requirement, match its form, principal/City recipient, sum, coverage and dates with the issuer, arrange execution and City-accepted filing, and obtain the approved permit.

The selected requirements call for advance departmental notices and, for specified sewer/utility work, geotechnical backfill testing and documentation. The water/sewer packet ties trench-security refund to accepted permanent repairs and identifies private-property plumbing work as a separate permit/inspection matter. Obtain the actual inspection, acceptance and release directions; the City's inspection does not create a private homeowner-contractor sewer guarantee.

Questions about this bond

Is every Birmingham ROW bond $2,500?

No. The utility application has scope-specific entries and Engineering determination; the water/sewer packet has different trench-security provisions. Obtain the actual requirement and accepted instrument.

Does the 15-day permit mean a 15-day bond?

No. It is the current application's default work-permit window, unless otherwise noted. The option displays no fixed term.

Does City approval guarantee the homeowner's sewer installation?

The packet treats any homeowner-contractor guarantee as a private arrangement, not a City obligation. Public-way acceptance, private-property plumbing approval and bond release are separate matters.
