Boone County, IN — Right Of Way Permit Bond

Match Boone County ROW security to the actual operation and County-approved sum. Its currently linked schedule and application disagree on paved-road-cut security, and the ordinance distinguishes project security, annual utility coverage and post-cut maintenance.

What this bond does

County-requested security for the permitted improvement in Boone County-controlled ROW and the applicable performance/payment conditions.

Who needs it
The actual permit applicant, coordinated with the project owner and contractor; the County ordinance includes Zionsville rural-service ROW only to the extent County-regulated.
Who it protects
Section 150.51 conditions permitted-work performance and lawful contractor/vendor/labor claims for that permit. The applicant's encroachment indemnity is separate from the accepted surety instrument and does not establish unlimited coverage.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Use the controlling operation and assigned security

The Highway Department handles County-road/ROW requests; a separate Road Closure application is needed when the operation closes a County road. Identify the actual road authority, work quantities, restrictions and project owner. A Zionsville address alone does not establish Town rather than County control.

The current schedule bases security on the controlling operation and lets the Highway Engineer/Commissioners adjust it. It lists different bore, linear-work, pole, drive and crossing categories and some no-bond categories—not a universal ROW minimum. For a paved-road cut, the linked schedule says $15,000 per location while the linked ROW application says $20,000. Obtain a written assigned sum before purchase rather than choosing between them yourself.

Separate project, annual utility and maintenance security

Recorded Ordinance 2023-10, adopted January 2, 2024, allows Engineer-approved annual utility security for multiple permits, with a $25,000 minimum and automatic renewal unless the surety gives written notice 60 days before annual expiration. That annual arrangement cannot cover drive or public-road-approach permits and is not automatically the product supplied here.

Road-cut bond release has a separate three-year maintenance-bond condition. Other maintenance security and qualifying continuous-utility substitutions require the Engineer's direction. The ordinance makes the full covered bond amount due when cancellation notice precedes completion of its conditions or required maintenance security is not provided. Obtain the accepted replacement/release direction before changing security.

Deliver accepted security and obtain the executed permit

Purchase Now opens Propeller; the option displays no fixed amount or term. Match the legal principal, County Board of Commissioners recipient, required instrument, assigned sum/date and actual project/annual scope. The current application directs original permit-bond copies to the Highway Department. Confirm the actual Engineer/Commissioners review path for the case.

Obtain the fully executed County permit and comply with its work-start and inspection directions. The ordinance requires inspection before bond release and treats final acceptance/encroachment obligations separately; a one-year permit clock is not the provider's bond term. Do not assume one ROW purchase supplies a separate required maintenance bond.

Questions about this bond

Which paved-road-cut amount should I order?

Ask the Highway Department to resolve it in writing. Its currently linked schedule states $15,000 per location and the linked application states $20,000; this page does not select one as controlling.

Can the annual utility bond cover a driveway permit?

The ordinance expressly excludes drive and public-road-approach permits from that annual arrangement. Have the Engineer identify the accepted project security.

Does completing a road cut end the permit bond?

Not automatically. The ordinance requires inspection and addresses a separate three-year maintenance bond before road-cut release. Obtain the actual accepted replacement/release instructions.
