What this bond does

Addresses a requested DeSoto construction ROW bond. It should not be substituted automatically for annual restoration security or a separate maintenance bond.

Who needs it
The contractor, facility owner or other applicant whom DeSoto requires to provide construction security for work in city ROW or easements.
Who it protects
The accepted instrument sets the covered obligation. DeSoto's permit conditions independently require repair of disturbed property and pavement and city inspection; other city materials describe separate annual restoration and maintenance security.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Get the applicable security requirement in writing

The city's ROW application special conditions list a $10,000 construction bond and a $2,000 amount where work does not exceed $2,000 for a permit. They also describe separate subdivision/development maintenance security.

The ROW ordinance linked by the city describes an annual bond based on anticipated restoration costs and separate maintenance security based on prior restoration costs, with provisions for qualifying utilities and alternatives. Those requirements should not be collapsed into one universal $10,000 bond or a single standard term. Ask which applies to this permit and this purchase option.

Identify who must be bonded

The application separates the permittee/contractor from the project owner and asks for subcontractors, the foreman and emergency contacts. The linked ordinance also distinguishes facility ownership and authorization to use the ROW.

Confirm whose legal name belongs on the requested instrument and whether it covers one permit or anticipated work over a period. Have the work address, description, estimated dates and city's selected security form ready before issuance.

A bond receipt is not permission to start

Use the existing Propeller construction ROW option after Engineering confirms the instrument match. The city application requires plans and expressly states that it is not a permit; approval is required before work begins.

The application conditions require inspector notification before starting and at completion, repair of affected yards, sprinklers, structures and pavement, and a final-inspection appointment. Submit the issued bond as directed, keep insurance separate and complete the city's permit approval process.

Sources

Have these ready

  1. Ask DeSoto Engineering which construction, annual restoration or maintenance requirement applies.
  2. Confirm the required principal, recipient, bond form, amount and coverage dates.
  3. Prepare the physical work address, plans, scope, dates, owner/contractor and subcontractor information.
  4. Arrange separate insurance, issued-bond delivery and city permit/inspection steps.

Questions about this bond

Is every DeSoto ROW bond $10,000?

No single figure should be assumed. The application lists fixed construction amounts, while the city-linked ordinance describes cost-based annual restoration and maintenance security. Have Engineering identify the requirement for your activity.

Is the construction bond the same as a two-year maintenance bond?

Do not assume so. DeSoto's materials identify maintenance security separately. Confirm the accepted instrument and applicable dates before purchasing or filing.

Can the contractor be named instead of the facility owner?

Use the principal required by DeSoto for the particular security. The application distinguishes contractor and owner, so their names should not be swapped without confirmation.

Does submitting the bond authorize work?

No. The application explicitly requires permit approval before work, with separate inspection and restoration responsibilities.
