Florida — CDL Third Party Tester Bond

Florida bases its CDL Third Party Administrator performance bond on individual test components, not just the number of drivers. A pre-trip inspection, basic-controls test and driving test count as three separate tests. Match the applicant administrator and its actual annual test count before selecting the required sum.

What this bond does

Maintain the nonexempt administrator's required performance security for its signed FLHSMV Third Party Administrator Agreement.

Who needs it
The organization seeking or maintaining Florida CDL Third Party Administrator approval. The individual employees who conduct skills tests are Third Party Testers and need separate valid certificates.
Who it protects
FLHSMV's published condition guarantees fulfillment of all terms, conditions and other requirements of the signed administrator agreement. Do not reduce that broader performance requirement to a fraud-only undertaking. Match the full accepted contract and security with the Department.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for component counts and the administrator

The Department sets $100,000 for up to 300 individual tests annually, $500,000 for 301–1,600, and $1,000,000 for 1,601 or more. Count pre-trip, basic control skills and driving separately. One hundred drivers each taking all three components account for 300 tests, before any other tests included in the Department's count.

Initial security uses the number of tests the administrator expects to conduct. For subsequent years, the required sum is based on actual tests performed in the previous year. Keep component-level records and have FLHSMV confirm the actual count and sum when renewing.

The requirement excludes State or local government entities and public school districts. Confirm the applicant's actual status; a private company does not become exempt simply because it serves a public school. The administrator must employ at least one currently certified Third Party Tester and maintain the required supervision.

The administrator needs a permanent Florida business location, supported by ownership or a binding lease with at least a one-year term. That lease minimum does not establish the bond's period. Coordinate the full agreement, accepted undertaking, actual dates, execution and continuation with FLHSMV.

The Department permits a qualifying letter of credit meeting its substantive requirements from a financial institution organized under Florida law. Purchase Now on this page continues to the bond application, not a letter-of-credit application. Have FLHSMV confirm the accepted security and filing for the actual agreement.

Questions about this bond

Do 100 drivers completing all three skills components count as 100 tests?

No. FLHSMV counts pre-trip inspection, basic control skills and driving as three separate tests. Those 100 complete sets account for 300 individual tests before any other tests included in the Department's count.

Does renewal always use the original forecast?

No. The published requirement bases subsequent years on actual tests performed during the previous year. Match the Department's count and required tier for the renewal.
