Florida — Cigarettes Distributing Agent Bond

Florida's cigarette distributing agent receives and stores a principal's cigarettes for delivery on that principal's orders. This warehousing role is different from owning and selling cigarettes or acting as a stamp-purchasing agent.

What this bond does

Match the CDA public-warehousing class and ABT-6032's Distributing Agent selection to the actual cigarette operation. The cigarette undertaking uses Chapter 210, Part I, not the separate tobacco-products condition.

Who needs it
Agents in Florida receiving cigarettes in interstate or intrastate commerce and storing them for a principal's ordered delivery. The principal can be inside or outside Florida; do not import another state's interstate-only agent definition.
Who it protects
The posted ABT-6032 binds the principal and surety jointly and severally to Florida for prompt accounting/payment of operational tax money due or becoming due, together with compliance with the selected cigarette laws in Part I. It is not warehouse inventory or cargo insurance.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for a Florida cigarette distributing agent

Section 210.01 distinguishes a distributing agent's receipt/storage/delivery role from an agent authorized to purchase and affix stamps. The ABT package lists CDA Public Warehousing separately from CWD wholesale-distributor classifications.

Section 210.085 permits the distributing agent to accept cigarettes from a permitted manufacturer or importer for transfer to a permitted dealer, but not to own or sell them. If the business actually trades on its own account, address the proper dealer activity with ABT before using the warehouse-agent application.

Section 210.08 requires acceptable security at 110 percent of estimated tax liability for thirty days, with a $2,000 minimum. Use ABT's assigned sum and accepted instrument rather than assuming that holding another person's cigarettes removes the requirement.

ABT-6032's cigarette model allows surety cancellation on sixty days' written notice to the Division and retains liability for covered acts before cancellation. The package says required-security expiry or cancellation stops further licensed transactions; obtain current directions for any replacement or release.

Complete the sworn application, principal/surety execution and properly certified surety-agent power of attorney. Current section 210.09 calls for electronic monthly reports by the following month's tenth day and three-year transaction records. Keep those reporting steps distinct from filing the bond/license material with ABT.

Purchase Now opens Propeller's Florida distributing-agent application in a new tab. Match the legal agent, CDA activity, principal/warehouse details, assigned sum and accepted dates, then complete ABT filing. Provider payment does not grant a permit, authorize ownership/resale or open stamp credit.

Questions about this bond

Can a distributing agent own and sell the cigarettes?

Section 210.085 says the distributing agent may receive for transfer to a permitted dealer but may not own or sell the cigarettes. Identify an actual dealer business separately with ABT.

Must every transaction be interstate?

Florida's definition includes receipt in interstate or intrastate commerce and principals inside or outside the state. Its role should not be replaced with another state's interstate-only definition.

Is this the stamping-charge application?

No. CDA public warehousing/distributing-agent activity is distinct from a stamp-purchasing agent or stamping-distributor charge arrangement.
