What this bond does

This bond serves to protect credit grantors who may suffer financial damage due to unlawful or fraudulent collection activities. It provides a legal mechanism for affected parties to seek restitution for losses resulting from an agency's failure to adhere to state laws and administrative rules.

Who needs it
Commercial collection agency owners and operators required to register with the Florida Office of Financial Regulation.
Who it protects
The agency and surety are jointly and severally bound to the Financial Services Commission as head of OFR, for the benefit of credit grantors. A credit grantor damaged by unlawful or fraudulent collection practices, or failure to comply with Chapter 559, Part V, its rules or lawful OFR orders, may sue on the bond. The surety's aggregate liability is $50,000.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Regulatory Requirements and Scope

Operating as a commercial collection agency in Florida necessitates compliance with Chapter 559, Part V, of the Florida Statutes. This statutory requirement mandates that agencies obtain and maintain a surety bond in the amount of $50,000.

The bond is continuous in form, subject to the cancellation and cessation-of-business terms described below. It is for the use and benefit of credit grantors.

Filing and Registration

To satisfy registration requirements, the principal must file a copy of the original surety bond with the Florida Office of Financial Regulation. This filing process is required both during the initial registration and upon every subsequent renewal.

The principal's authorized representative must sign before a witness, with the form's execution and seal requirements completed. If the principal or surety is served with a bond action, each party served must immediately notify OFR in writing by U.S. certified mail.

Purchase Now opens Propeller's commercial collection agency checkout in a new tab. Match the agency's legal details to its OFR registration, review the completed $50,000 bond, and file the required copy with OFR. Purchasing the bond does not submit or renew the registration.

Bond Cancellation and Liability

The surety's cancellation takes effect 30 days after service of its written notice on the principal and OFR by U.S. certified mail. The surety remains liable for obligations that accrued through a default before cancellation became effective.

If your agency stops acting as a commercial collection agency, send that notice to the surety by U.S. certified mail. Future liability ceases when the surety receives the notice, not when it later forwards a copy to OFR. The surety has 14 days to forward the copy, and liabilities incurred or accrued during the bond period remain.
