What this bond does

Provide the bond alternative under Section 516.05(10) for a Chapter 516 consumer finance license, rather than add a universal bond requirement to businesses already meeting the liquid-asset test.

Who needs it
Florida consumer finance applicants or licensees choosing bond security for the main location and any additional licensed offices.
Who it protects
The security benefits borrowers injured by the licensee's fraud, misrepresentation or deceit in a Chapter 516 loan, including the specified illegal charges and disclosure misconduct. The Office or a claimant may bring an action; it is not insurance against every lending loss.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

Section 516.05(10) allows a bond of at least $25,000 in place of the $25,000 liquid-asset requirement. A company with an existing licensed location must provide at least $5,000 in additional bond or rider security for each additional license, subject to the $100,000 aggregate cap. The statute also permits a qualifying certificate of deposit or irrevocable letter of credit. Confirm the accepted arrangement and existing coverage; do not assume every location needs a separate $25,000 bond.

The original security is filed with the Office as beneficiary. The statute provides pro rata payment within the security amount and requires replenishment after recoveries reduce it. Cancellation requires notice received by the Office at least thirty calendar days beforehand. Security must remain for two years after licensed operations cease, although the Office may permit a reduction or elimination as outstanding Florida loans decline. These rules are separate from the license's biennial renewal cycle.

Purchase Now opens Propeller's Florida consumer finance application in a new tab. Bring the Office's request, exact licensee and office details, existing security, required aggregate sum, effective date and accepted OFR-516-02 form. Check them before paying. Complete the form's signatures and principal witness, arrange the original filing with the Office and retain its acceptance; checkout does not issue or renew the consumer finance license.

Questions about this bond

Is this bond required in addition to the liquid assets?

The statute offers the bond in lieu of the specified liquid-asset requirement. Confirm which route the Office accepts for your company and locations.

Does every additional office need another $25,000?

The statute provides at least $5,000 additional security per additional license for a company with an existing licensed location, with a $100,000 aggregate cap. Have the Office confirm the total and rider arrangement.

Can security end as soon as the company stops lending?

Not automatically. The statute requires security for two years after licensed operations cease, subject to Office-approved reduction or elimination as outstanding loans decline.

Does the bond insure the lender against loan defaults?

No. It secures the specified borrower protections against the licensee's misconduct, not repayment of the lender's loan book.
