Gastonia, NC — Provider Of Shared Mobility Devices Bond

Gastonia requires its shared active transportation system permittees to provide a performance bond or other security acceptable to the director. The bond guarantees all obligations under the provider's permit. Use the City's approved form and assigned amount, especially if your request involves a change in the deployed fleet.

What this bond does

Secure performance of the shared-device provider's obligations under its Gastonia permit, as required by section 21-8(c). Match the legal permittee, approved security and actual permit terms.

Who needs it
Businesses operating Gastonia's permitted dockless shared active transportation systems, including the shared bicycles, electric-assisted bicycles and motorized scooters defined by Chapter 21. This is provider security rather than an individual rider's application.
Who it protects
The City receives security guaranteeing the permittee's performance of all permit obligations. These obligations include applicable device-management and public-property responsibilities. The bond does not replace the provider's separately required insurance or duty to defend and indemnify the City.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the provider permit and fleet security

The planning department administers Chapter 21 permits. A permit lasts one year and is renewable under the initial issuance standards; it is not an exclusive right to operate. Keep the actual permit and any fleet-size or operating-area conditions with the security request. The permit period does not by itself settle the bond's continuation or cancellation wording.

Section 21-8(c) leaves the amount to the director, sufficient to cover the permittee's obligations. The department approves the form after consulting the City Attorney, and one or more sureties legally authorized in North Carolina must execute it. Obtain the City's determination instead of assuming a standard amount or using another city's scooter form.

Where the amount is set by the number of deployed devices, submit a revised performance bond or other acceptable security before deploying additional devices. Coordinate the intended fleet increase with the City; buying security does not amend a permit or authorize a larger fleet.

Chapter 21 separately addresses removal and re-parking, unsafe devices, rebalancing and reimbursement of City removal and storage costs. It also makes the permittee responsible for repairs to public property damaged by customers' use. Use the actual permit and approved condition to keep those duties aligned, with required insurance remaining in place.

Questions about this bond

Is there one standard bond amount for every provider?

Section 21-8(c) directs the director to determine sufficient security for the permittee's obligations. Obtain the actual City determination. The code does not establish one universal amount for every fleet.

Can I increase the fleet before updating the bond?

Where the amount is based on deployed device count, the code requires revised performance security before additional devices are deployed. Confirm the City's permit and fleet conditions as well; a bond purchase does not itself authorize the increase.
