Georgia — Check Cashing Bond

Georgia's check-casher bond applies when a licensed business accepts checks for collection and defers payment until collection. Ordinary check cashing requires immediate cash payment. Confirm that deferred-collection activity and the full location count before arranging Section 7-1-707(c) security.

What this bond does

Provide the security required for the deferred-collection exception in Georgia Code Section 7-1-707(c), rather than assume every licensed check casher needs the same undertaking.

Who needs it
The actual Georgia check-casher licensee accepting checks for collection with payment deferred. This is not a way to authorize delayed-deposit lending or import the different money-transmitter minimum into a check-casher filing.
Who it protects
Section 7-1-707(c) runs the undertaking to Georgia for any claimant against the licensee arising from its business of cashing payment instruments with payment deferred in Georgia. It incorporates the money-transmitter filing manner and conditions by reference, but supplies its own check-casher location-based sum and cancellation rule.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for deferred collection and the location count

Section 7-1-707(b) ordinarily requires immediate cash payment for each accepted payment instrument. Subsection (c) permits checks to be accepted for collection with payment deferred only with the required security. Once the licensee collects on the check, it must immediately pay the customer; security is not permission to keep collected proceeds.

Count every location operated by the licensee. The aggregate is $10,000 for each of the first three locations, plus $5,000 each for the fourth and fifth, plus $1,000 for every location beyond the fifth. For example, four locations require $35,000 and six require $41,000. Do not substitute the separate money-transmitter minimum merely because the filing statute refers to money-transmitter procedures.

The condition must be satisfactory to the Department for this actual deferred-payment check-casher activity. Match the legal licensee, NMLS company, all locations, sum and operative terms. Section 7-1-707(c) makes cancellation effective no sooner than thirty days after the Department receives notice. Follow the current Department/NMLS process rather than assuming the date a provider receives an application is the cancellation date.

Georgia uses NMLS for check-casher applications and changes; apply for Georgia branches at the same time and do not enter out-of-state branches as Georgia branch applications. The Department's current rules specifically penalize deferred payment without the required undertaking. Complete the license checklist and current electronic security instructions separately from payment to the provider.

  2. Identify the licensed principal, NMLS company and full location count.
  3. Calculate the aggregate using the three location tiers and match the Department request.
  4. Arrange the accepted deferred-collection condition, operative dates and current electronic execution.
  5. Complete the NMLS license/Georgia-branch requirements and current filing instructions.

Questions about this bond

Does every Georgia check casher need this security?

Section 7-1-707(c) applies to accepting checks for collection with payment deferred. Ordinary payment is immediate under subsection (b). Describe the actual service before choosing the undertaking; the check-casher license itself remains a separate requirement.

Can payment stay deferred after the business has collected on the check?

No. Subsection (c) requires payment immediately after collection. The undertaking secures the permitted collection arrangement; it does not allow a licensee to continue holding collected proceeds.

What follows Purchase Now?

Propeller's Georgia Check Cashing application opens in a new tab. Match the actual deferred-collection licensee, NMLS record, location-based sum, accepted condition, period and electronic execution, then complete Department filing. Payment does not establish that an ordinary check-cashing business needs this filing or approve deferred collection.
