Harris County, TX — Right Of Way Bond

Harris County's ROW process distinguishes a new standard bond from the perpetual-bond route for public utilities. Match the approved plans, work type and county-required amount before applying; a Houston city street-work bond is not automatically the same instrument.

What this bond does

Provides the county-required security for covered construction of facilities in Harris County or Harris County Flood Control District ROW, using the applicable county form and review route.

Who needs it
Contractors providing standard security for approved Harris County ROW construction; public utilities should first confirm whether the county's separate perpetual-bond route applies.
Who it protects
The standard form secures performance of the work described in the construction request and plans, reimbursement of county loss from default, and a one-year warranty following final inspection approval.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Choose standard or perpetual security

For standard ROW notifications, Harris County requires a new county-form bond, not an existing bond. It separately publishes a perpetual-bond route for public utility companies or engineering firms acting for them. Confirm which route applies before applying for this option.

The standard form secures the work described in the construction request and plans. It names Harris County and addresses facilities in county or Flood Control District ROW; it is not general permission for work on every road in a Houston mailing area.

Use the amount calculated for the work

The standard page states a $5,000 minimum and $5,000 for ordinary ROW crossings, with listed exceptions. It gives $8 per linear foot for non-irrigation linear work and $2 per foot for irrigation installation.

For traffic signals it specifies $80,000 or 100% of construction cost, whichever is greater. Median modifications, turn lanes, widening, storm-sewer bores/tunnels and roadway open cuts use $40,000 or 100% of cost, whichever is greater. Have Public Review confirm the calculation for combined or unusual work instead of selecting the minimum by default.

Issue the county form, then complete notification and inspections

Use the existing Propeller option with the confirmed county request. The county requires its approved format, original signatures and a power of attorney. Its page provides mail/hand-delivery and E-Permits submission options; follow the applicable execution and seal requirements rather than submitting only a purchase receipt.

Obtain ROW notification approval and provide the county's 48-hour start-of-construction notice. The standard form remains valid through the one-year warranty following final inspection approval. The county lists a warranty-inspection request 90 days before bond expiration; maintain the project's inspection records and dates.

Questions about this bond

Can I reuse an existing bond?

Harris County publishes standard and perpetual arrangements separately. For standard notifications it requires a new bond on the county form; public utilities have a separate perpetual-bond route. Confirm the applicable arrangement.

Is every Harris County ROW bond $5,000?

The standard-bond page states a $5,000 minimum but also gives different amounts for crossings, linear work, irrigation, traffic signals and specified higher-impact road work. Have Public Review confirm the calculation for your plans.

When does the one-year warranty matter?

The county standard form remains valid through the one-year warranty following final inspection approval, not simply one year from purchase. The county lists a warranty-inspection request 90 days before bond expiration.

How do I purchase this offering?

Use the existing Propeller option with the county's request and approved form. After issuance, complete county bond submission and ROW notification approval; the purchase does not authorize construction.
