Illinois — Immigration Service Provider Bond

Nonexempt Illinois immigration-assistance providers register with the Attorney General and submit the required financial verification. Part 485 permits $100,000 malpractice insurance or a $100,000 surety bond. The Southern Agency’s listing concerns the business-conduct surety route—not an immigration detention bond or permission to give legal advice.

What this bond does

The prescribed Exhibit C instrument runs to the People of the State of Illinois. It is conditioned on compliance with the Consumer Fraud Act’s immigration-services provisions and on not damaging a person through a violation.

Who needs it
The actual nonexempt provider offering permitted nonlegal assistance. Section 2AA has exemptions for specified attorneys, supervised legal interns, recognized/accredited nonprofit activities and certain employer assistance without compensation from the assisted person. Determine the real role before assuming registration or this purchase is necessary.
Who it protects
The form provides for Attorney General or county State’s Attorney action against the principal and surety to recover damages. Surety liability for a claim is limited to actual damage from the principal’s violation, with all claims together limited to the bond amount. It is not a fresh $100,000 for each client or a guarantee of immigration status.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Register the actual provider with the Attorney General

Exhibit A asks for the provider’s name/address, legal structure, people authorized to accept process, and people owning or controlling at least ten percent of the business. It separately records insurance or surety details, amount and expiry. Keep the principal consistent with that registered operation rather than substituting a notary appointment or unrelated trade name.

Part 485 requires annual registration and financial reverification by the original filing’s anniversary. Changes in registration or verification information must be reported in writing within ninety days. Registration is expressly not State approval of the provider’s business practices.

Keep legal judgment outside the assistance role

The Act permits specified tasks such as transcribing a customer’s answers, translating and obtaining existing supporting documents. It excludes legal advice, recommending a legal course and work requiring legal analysis or interpretation. A notary title or the word consultant does not supply that authority.

Prepare the client contract in English and the customer’s language, with the required cancellation explanation and document-return provisions. Required customer notices must appear in the languages used. These are practical conduct duties behind the security—not a promise of special influence with immigration authorities.

Use the surety verification, not the insurance form

Exhibit C is the surety document; Exhibit B is malpractice-insurance verification. The surety form asks for bond number, amount, expiry, principal/address, authorized surety, and execution by authorized representatives, with the displayed notarial/seal requirements. Use the Attorney General’s accepted completion instructions.

The exhibits state that the financial protection is continuously maintained and also call for a bond for two years after operations cease. That post-closure provision is not a two-year term offered by this unlabeled public purchase option. Confirm actual continuation, closure or replacement instructions before allowing protection to end.

Purchase Now opens Propeller in a new tab. Compare the actual provider/principal, People of the State recipient, $100,000 sum, accepted form, and dates before completing the application. File the verification with the Attorney General registration as instructed; purchasing does not register the business, approve legal practice or decide a customer’s immigration matter.

Questions about this bond

Must I buy this bond if I use qualifying malpractice insurance?

Part 485 allows the stated $100,000 malpractice or surety route while operating, with the correct verification. The exhibits also address a post-closure bond period. Confirm the actual accepted method and continuation instructions rather than buying by assumption.

Does registration authorize me to advise on immigration strategy?

No. Section 2AA excludes legal advice and work requiring legal judgment or interpretation from the nonlegal assistance role. Registration and financial security do not change that boundary or establish government endorsement.

Is the two-year closure provision the term shown for purchase?

No. It addresses protection after operations cease. This public option supplies no term label. Match the actual accepted dates, annual reverification and continuation/closure requirements separately.
