Illinois — Tobacco Products Distributor Tax Bond

Confirm that Illinois Revenue requires a tobacco-products bond for your account before ordering. Current section 10-20 contains first-time and lower-liability exceptions, and the registration schedule directs distributors to Revenue for their actual bonding requirement.

What this bond does

The bond provides security for amounts due under the Tobacco Products Tax Act. Where required, Revenue fixes an amount within the statutory limit and approves the form for the licensed distributor and business location.

Who needs it
Tobacco-products distributors with an Illinois security requirement. A retailer receiving untaxed products from a supplier not registered as an Illinois tobacco-products distributor can also have distributor duties; a cigarette license or retail label does not by itself identify the correct account.
Who it protects
REG-4-A binds principal and surety to the people of Illinois. Its condition requires payment to Illinois Revenue of all amounts becoming due under the law identified in the bond-type field. Identify Tobacco Products Tax accurately so the undertaking secures that account, rather than an unrelated cigarette, fuel or other tax obligation.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for Illinois tobacco-products security

Current section 10-20(a) excepts a first-time distributor-license applicant and a distributor with less than $50,000 of tax liability in the preceding year from its ordinary bond requirement. Revenue's general tobacco page summarizes the calculation more broadly; the current REG-1-C schedule tells applicants to contact the registration-bond unit. Obtain an account-specific direction before purchasing security you may not need.

Where that ordinary requirement applies, Revenue sets the sum at no more than three times average monthly tax liability or $50,000, whichever is lower. The Act separately requires a reapplicant after license revocation to provide three times the average monthly liability calculated immediately before revocation. Have Revenue identify which provision and amount apply to you.

Do not copy the $2,500 cigarette-distributor or cigarette-machine amount from another part of REG-1-C. Tobacco-products classification includes products and activities distinct from the cigarette account. Describe what you sell, who receives it and whether tax was paid by the supplier; retail operations may require separate registration.

A separate distributor application and required bond apply to each place of business. The Act requires security throughout the licensed period except for its release provisions. It directs release within ninety days after qualifying prior continuous compliance, or qualifying closure with a final return and payment of the remaining liability Revenue determines. Arrange the Department's release rather than assuming the license date cancels the instrument.

REG-4-A requires a power of attorney and has principal/surety seals and signature fields to complete for the applicant's business structure. Its surety-cancellation provision uses written notice filed with Revenue by registered or certified mail and a ninety-day period, preserving earlier and intervening liability. Do not substitute a thirty- or sixty-day notice from another tax bond.

Purchase Now opens Propeller's Illinois tobacco-products application in a new tab. Match Revenue's request, legal applicant, location, tax type and approved sum, then complete state registration and security submission separately. Provider payment does not determine an exemption or issue the distributor's license.

Questions about this bond

Must a first-time distributor automatically buy a bond?

Current section 10-20(a) excepts first-time applicants from its ordinary requirement and also excepts distributors with less than $50,000 of prior-year liability. REG-1-C directs applicants to Revenue for possible bond requirements. Obtain your account-specific direction before ordering.

Is this the $2,500 cigarette bond?

No automatic amount transfer applies. REG-1-C lists $2,500 for other cigarette classes, while the tobacco-products account uses its applicable statutory rule and Revenue's required sum.

Can a retailer also be a tobacco-products distributor?

Yes. Revenue includes a retailer receiving untaxed products from a supplier not registered as an Illinois tobacco-products distributor. Describe your supply arrangements so the Department can determine the correct registrations.

Does the bond automatically end when I stop trading?

The Act has a release process tied to qualifying compliance or closure, a final return and discharge of remaining liability. The model also has a separate surety-notice procedure. Obtain Revenue's release or replacement instructions rather than simply stopping coverage.
