Maryland — Cigarette Tax Bond

Have the Comptroller's cigarette-tax security request before ordering. Maryland's law allows security to be required and sets different amounts for manufacturers/wholesalers and subwholesalers/vending operators; it does not make every tobacco business a $10,000 applicant.

What this bond does

Tax-General sections 13-824 through 13-826 authorize acceptable security for tobacco-tax revenue. Match the cigarette business's actual class, tax liability and Comptroller-assigned requirement.

Who needs it
Cigarette manufacturers, wholesalers, subwholesalers or vending-machine operators responding to a Maryland tax-security request. Other-tobacco wholesalers and out-of-state sellers have distinct statutory amount provisions.
Who it protects
Section 13-824 secures payment of tax, interest and penalty that is due or may become due to Maryland. A bond must be issued by an authorized surety approved as to solvency and responsibility. This is state tax-revenue protection, not insurance for the business's stock or customers.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for a Maryland cigarette-tax security request

Section 13-825(h) says the Comptroller may require tobacco-tax security. For a manufacturer or wholesaler, it specifies $10,000 plus any amount by which tax due for one month exceeds $10,000. The corresponding base for a subwholesaler or vending operator is $1,000, with the same monthly-excess approach.

Other-tobacco wholesalers and out-of-state sellers have separate $5,000 provisions, including a reporting-period calculation for the latter. Do not import those amounts or another form's product class into a cigarette account merely because all are tobacco businesses.

The five-year provision is not an automatic release. The Comptroller may grant a qualifying licensed person's exemption only after the required continuous tax/security compliance and a determination of solvency and ability to pay potential liability. The exemption is limited by the approved potential exposure and can be revoked for noncompliance.

A corporation granted an exemption has an additional statutory consequence: an officer directly controlling fiscal management becomes personally liable for its tobacco tax, interest and penalties. Review the actual exemption decision rather than treating bond removal as removal of tax responsibility.

Use the Comptroller's current accepted instrument, sum, period and execution instructions. Section 13-826 also permits other approved security, but this listing is a surety-bond application. Do not assume an alternative security or a license renewal substitutes for the requested bond or releases existing liability.

Match the legal tax account, actual class, written requirement and accepted dates, then complete Comptroller filing and any separate licensing steps. Provider payment does not issue a license, grant an exemption or pay the underlying tax.

Questions about this bond

Does every cigarette business need a $10,000 bond?

The Comptroller may require security and different classes have different statutory calculations. Manufacturers/wholesalers use the $10,000-plus-monthly-excess provision; subwholesalers/vending operators have a $1,000 base. Obtain the actual request.

Can I cancel after five compliant years?

Do not assume automatic release. The exemption requires the Comptroller's qualifying compliance and financial determination, has an exposure limit and can be revoked. Follow the actual decision and accepted instrument.

Does an exemption eliminate a corporation's tax exposure?

No. Taxes remain due. The statute also makes an officer exercising direct fiscal control personally liable for a corporation's tobacco tax, interest and penalties when the corporation receives the security exemption.
