What this bond does

File the Consumer Loan Law security required with the license application, keeping the company's licensing, financial evidence and location disclosures separate.

Who needs it
Maryland Consumer Loan applicants and licensees making loans under the Consumer Loan Law, and acquirers needing that authority to enforce such loans.
Who it protects
The bond runs to Maryland's Commissioner for the State and people with causes of action under the Maryland Consumer Loan Law. It secures compliance with that law and payment of money owed under it; the statute also permits specified regulatory penalties to be collected from the bond.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

Financial Institutions Section 11-206 requires the bond with the application and directs the Commissioner to choose a company amount from $50,000 to $200,000. The nature and volume of the business, financial condition, operations and control can affect that determination. The principal executive office holds the license; additional locations conducting Maryland business must be disclosed under the current instructions rather than bought as separate branch licenses. A Consumer Loan licensee's stated installment-licensing exemption does not turn the two bond forms into interchangeable products.

The full Consumer Loan form and statute cover legal compliance and money owed to the State or qualifying people. Liability is continuous and noncumulative. A claimant may file with the surety without prior administrative enforcement; excess claims are paid to the Commissioner for pro rata distribution under the statute. Cancellation takes effect ninety days after the Commissioner receives the specified notice, and liability continues three years after the later of cancellation or the end of licensing. Claim payments can require replacement security.

Questions about this bond

Is the bond always $50,000?

No. Section 11-206 sets a range of $50,000 to $200,000, with the actual amount determined by the Commissioner for the licensee.

Do additional locations each need another license?

Since July 1, 2023, the programme uses the principal executive office license and requires disclosure of additional Maryland-business locations. Follow the current location-list and NMLS instructions.

Must the Commissioner take enforcement action before a claim?

No. The statute says administrative enforcement is not a prerequisite to surety liability and permits a claimant to file with the surety. A claim still must fall within the secured law and terms.

Is the three-year provision a selectable bond term?

No. It concerns continuing liability after the later of cancellation or the end of licensing. The separate ninety-day cancellation notice does not erase that continuation.
