Maryland — Home Builder Deposit Bond

This bond protects qualifying home-buyer payments when a Maryland builder or seller uses surety security instead of the applicable escrow arrangement. It concerns return of protected payments when due, not a general promise to finish every home.

What this bond does

Secure protected new-home deposits and qualifying custom-home advance payments under Real Property Title 10, Subtitles 3 or 5.

Who needs it
Builders or sellers receiving protected payments before completion and transfer, and custom home builders using the statutory surety alternative where applicable. Registration alone does not mean every builder must buy this bond.
Who it protects
The Attorney General's sample makes the State of Maryland beneficiary for protected consumers. Its covered-entity provision includes the builder or seller and related entities unless expressly excluded, with claims made by the State through the Consumer Protection Division's certification process.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

For the new-home transactions described in §10-301, the law provides escrow, a corporate surety bond or an eligible irrevocable letter of credit as alternatives. Section 10-302 requires a CPD-approved bond deposited with CPD and allows individual or qualifying blanket security. The blanket amount follows a statutory deposit schedule measured using deposits held on May 31, rather than one fixed sum for every builder. Custom-home §10-504 separately provides a surety alternative to the escrow it requires, subject to its own scope and exceptions.

The current linked sample asks for the legal builder or seller, MHBR number, covered and expressly excluded entities, amount and start date. It requires 45 days' certified-mail notice to CPD before cancellation or a reduction in amount or coverage. Under that model the State can demand payment with CPD's certification no later than one year after cancellation, and the surety must pay a qualifying demand within 30 days, up to the bond amount. Cancellation is not permission to leave protected payments unsecured.

Purchase Now opens Propeller's Maryland Home Builder Deposit application in a new tab. Bring the written requirement, current CPD-approved form, legal entity and MHBR details, covered/excluded entities, deposit totals, applicable amount basis and dates. Confirm the transaction category and accepted security with CPD and the provider before paying. Execute and deposit the bond as instructed, retain acceptance and continue the required protection; purchase does not register the builder or decide whether a consumer is entitled to a refund.

Have these ready

  1. Identify the transaction and protected payments: new-home deposit or applicable custom-home advance-payment obligation.
  2. Have the legal builder/seller, MHBR number, covered entities and any express exclusions available.
  3. Bring the deposit totals and applicable statutory amount basis, including the relevant May 31 balance for blanket security.
  4. Confirm the current CPD-approved form, amount, start date, execution and filing; do not reuse the linked legacy certification form's old 2005 balance date.

Questions about this bond

Must every registered Maryland builder buy a deposit bond?

No. The applicable deposit-protection rules depend on the transaction and payments. Section 10-301 provides escrow, surety or an eligible letter of credit as alternatives; custom-home requirements have their own scope and exceptions.

Is there one fixed bond amount for all builders?

Section 10-302 permits individual or qualifying blanket bonds. Blanket security follows its deposit schedule and annual May 31 measurement; confirm the applicable amount with CPD rather than selecting a universal figure.

Does the sample cover only the named building company?

Its covered-entity language extends to related entities through which the builder or seller builds or sells Maryland homes unless expressly excluded. Review the actual entity list and exclusions before issuance.

Does 45 days' cancellation notice end every possible claim?

The linked sample also permits the State's certified demand up to one year after cancellation. Its notice and claim provisions do not remove the builder's obligation to maintain the protection the applicable law requires.
