Massachusetts — Blasting Operations Blanket Bond

For blasting in more than one Massachusetts city or town, Chapter 148 §20A allows a bond filed with the State Treasurer instead of separate local bond filings. The statutory State bond is $20,000 plus any additional amount the Marshal requires.

What this bond does

Secure the loss, damage or injury obligations applicable to the multiple-municipality blasting bond under §§19, 20 and 20A.

Who needs it
A blasting operator seeking the State multiple-place bond arrangement. Companies also need their DFS Explosives User Certificate; individual competency licensing and local project permits remain separate.
Who it protects
The State bond runs to the Commonwealth, with the applicable condition covering loss, damage or injury to persons or property from blasting or keeping explosives. The statutory action excludes personal injury to the permittee's employee and provides proportional payment when established claims exceed the bond sum.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

Section 20A addresses operations in more than one city or town: file the bond with the State Treasurer, running to the Commonwealth, with sureties the Treasurer approves. The $20,000 statutory sum is not a ceiling if the Marshal requires additional security. Local §19 bonds have different recipients and sums; do not assume the State arrangement removes local blasting-permit requirements.

Sections 19 and 20 supply the applicable damage condition and action rules. An injured person may bring the statutory action in that person's own name and at that person's expense, subject to the employee-personal-injury exclusion and proportional-payment rule. Separately, DFS's company-certificate instructions require evidence of at least a $20,000 blasting bond or a continuation letter showing a paid-to date. The FP-083 application waives that bond-evidence requirement for work limited to research and development; do not treat that as a blanket exemption from project rules.

Purchase Now opens Propeller's Massachusetts blasting-blanket application in a new tab. Bring the written request, State §20A form and beneficiary, legal operator name, operating locations, amount including any Marshal-required addition, dates and continuation needs. Confirm the form, surety approval and filing instructions before paying. Complete the State bond filing and provide DFS's requested certificate evidence separately; retain acceptance and obtain the necessary company, individual and local approvals before work.

Sources

Have these ready

  1. Confirm the request is for the State multiple-city/town bond rather than a particular local §19 bond.
  2. Identify the legal operator, locations, State beneficiary and Treasurer-approved form and surety requirements.
  3. Check the $20,000 statutory sum plus any Marshal-required addition, dates and continuation evidence.
  4. Keep State bond filing, DFS company-certificate documents, individual competency licensing and local project permits distinct.

Questions about this bond

Does blanket coverage mean no local blasting permit is needed?

Section 20A substitutes a State bond filing for separate local bond filings when operating in more than one city or town. It does not itself issue a local project permit or an individual competency license.

Is $20,000 always the maximum security required?

Section 20A states $20,000 and permits an additional amount the Marshal determines necessary. Match the actual required sum rather than treating the printed statutory figure as a universal ceiling.

Are all injured employees covered by this statutory bond action?

Section 20 excludes an action on the bond for personal injury to an employee of the permittee. Do not describe the bond as covering every employee injury or every loss without its statutory conditions.

What does DFS require for a company's renewal evidence?

Its instructions require valid blasting-bond evidence or a continuation letter with a paid-to date and call for renewal submission before expiry. FP-083's research-and-development-only waiver concerns that application requirement; it is not an automatic exemption from all blasting obligations.
