Michigan — Wholesaler Or Unclassified Acquirer Of Tobacco Products Bond

Michigan Treasury may require security for a tobacco wholesaler or unclassified-acquirer license in an amount it fixes. Start with the actual Treasury request; the law's $25,000 initial net-worth criterion is not a universal $25,000 bond requirement.

What this bond does

Match the tobacco role on Treasury's shared Form 702 to the applicant's actual license and account. Select the wholesaler/unclassified-acquirer category and remove the nonapplicable motor-fuel/carrier wording.

Who needs it
Wholesalers and unclassified acquirers responding to a Michigan tobacco-license security request. Section 205.423 also requires an unclassified-acquirer license for remote retail sales to Michigan consumers.
Who it protects
Form 702 binds the principal and surety jointly and severally to Michigan's people. The tobacco condition requires legal compliance, true reports, taxes and penalties paid as required, and further security when Treasury demands it.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for Michigan wholesaler or acquirer security

Section 205.423 makes licensing specific to the business place and capacity. Acting in more than one capacity at a place requires a license for each. Have Treasury address the actual wholesaler or unclassified-acquirer activity rather than assuming one category covers all distribution.

The current statute permits Treasury to require an authorized-surety bond in its assigned amount, conditioned on payment of the Act's tax. Form 702 provides the fuller tobacco compliance/reporting/tax-and-penalty undertaking.

The model calls for further security on ten days' written notice to the principal. That is not its surety-withdrawal period. Withdrawal uses written notice to Michigan, retains liability through sixty days after the request and expressly does not waive applicable statutory provisions.

Enter the accepted effective and expiration dates; the form has both fields. Complete the actual principal/surety signatures and seals, corporate officer execution where applicable, and the required authorizing resolution/power of attorney for entity execution.

Purchase Now opens Propeller's Michigan application in a new tab. Match the legal applicant, Treasury account, tobacco category, assigned sum and accepted dates, then complete Treasury license/security filing. Provider payment does not grant a license or establish stamp-purchase credit.

Questions about this bond

Is the $25,000 net-worth figure the bond amount?

Section 205.423 treats initial financial-responsibility evidence separately from a surety bond in the amount Treasury may fix. Use the actual security request.

Do ten days' notice end the surety's liability?

The ten-day provision concerns demanded further security. The model's separate withdrawal clause retains liability through sixty days after the request and preserves applicable statute.

Can I leave the motor-fuel wording selected?

The shared form says to mark one license category and remove nonapplicable wording. Match the wholesaler/unclassified-acquirer tobacco request.
