What this bond does

Supply the accepted security accompanying a covered commercial financing broker's Division of Finance registration.

Who needs it
Businesses obtaining and communicating third-party commercial financing offers for compensation, subject to the law's definitions and exemptions.
Who it protects
The statute makes the bond in favor of Missouri and permits a person damaged by the broker's covered breach of contract, related obligation or violation to bring an action against it. Surety liability is limited to actual damages and cannot exceed the bond sum.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

The current Commercial Financing Disclosure Law separates broker registration from providers' transaction disclosures and lists exemptions. Its broker definition excludes a provider and people whose compensation does not depend on the specific transaction. Regular employees acting within a complying broker's employment do not separately register or bond under that provision. Match the actual business role rather than assuming every commercial lender needs this security.

Section427.300(5) requires the $10,000 bond and annual registration renewal by January31. The Division's selected registration packet asks for the bond in favor of the Commissioner of Finance for anyone aggrieved by unlawful acts of the registrant. Match that accepted naming and full condition to the statutory State protection. The express bond action is not a promise of unlimited damages or a general private right to enforce every disclosure or collect statutory fines.

Purchase Now opens Propeller's Missouri Commercial Financing application in a new tab. Bring the Division's current broker request, exact company and DBA, business address and designated Missouri agent, accepted undertaking, required sum and dates. Match the broker role and instrument before paying. Arrange execution and attach the bond to the completed registration, follow the Division's accepted email or mail instructions and retain acceptance. Keep registration renewal and its separate payment evidence distinct from buying the bond.

Questions about this bond

Does every commercial financing provider need this broker bond?

No. The law distinguishes a provider from a broker and lists exemptions. Match the actual activity to the Division's registration request.

Does a regular employee need a separate bond?

Section427.300(5)(7) exempts regular employees acting within the scope of employment for a broker that has complied with the provision.

Is there a right to recover unlimited damages?

No. The express bond provision limits aggregate surety liability to actual damages up to the bond sum. It is not blanket repayment protection or a general right to collect regulatory penalties.

Does the January renewal date set my purchased bond term?

It sets the broker registration renewal deadline. Match the accepted bond's effective period and continuation requirements separately.
