Nebraska — Collection Agency - NMLS Bond

Nebraska's collection agency bond amount depends on the agency's solicitor count. Section 45-608 sets $5,000 below five solicitors, $10,000 for five through fifteen and $15,000 for sixteen or more. Confirm the count and amount with the Collection Agency Licensing Board before ordering through this NMLS-labelled option.

What this bond does

The bond secures faithful performance of the agency's agreements with clients and customers. It also backs reporting and payment of net collection proceeds within 45 days after the close of each calendar month.

Who needs it
Collection agencies completing Nebraska licensing through the Secretary of State and Collection Agency Licensing Board. Bring the legal agency name and current solicitor list. The Board now directs new applications, branch applications and solicitor submissions through NMLS.
Who it protects
The bond is payable to and approved by the Board, with protection for clients or customers harmed by a failure to account, pay or perform their agreements. A damaged person may bring an action in a court of competent jurisdiction. Total surety liability to all such people cannot exceed the bond sum.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

Use the Board's solicitor count for the $5,000, $10,000 or $15,000 tier rather than assuming every agency needs the same sum. The statute also says no person must post more than $100,000. Have the Board confirm any amount above the ordinary tiers; that ceiling is not the standard amount for every application.

Section 45-608 covers the agency's client agreements as well as monthly accounting and remittance. The protected breach can therefore extend beyond a missing payment if the agency fails to perform its agreement with the injured client or customer.

The Secretary of State's current programme says new paper license applications are no longer accepted and directs applicants to NMLS. Older posted application packets contain paper instructions and a specimen ending on December 31. Use the current licensing request for the accepted bond document, execution, delivery and dates rather than assuming the old packet establishes today's filing route or a fixed purchase term.

Purchase Now opens Propeller's Nebraska NMLS-labelled bond application in a new tab. Have the agency's NMLS record, exact legal name, solicitor count and Board request ready. Check the issued sum and condition, and confirm the Board's current bond-delivery requirements with the provider. Complete the separate NMLS licensing steps; checkout does not grant or renew the agency license.

Questions about this bond

How is the ordinary bond amount determined?

Section 45-608 uses solicitor counts: below five, $5,000; five through fifteen, $10,000; sixteen or more, $15,000. Confirm your agency's count and any different Board request before ordering.

Does protection only concern missing client money?

The statute also secures faithful performance of agreements with clients and customers. It allows an action by a person harmed by the agency's failure to account, pay or comply with its agreement, within the aggregate bond limit.

Can I rely on an older paper licensing packet?

The current Secretary of State programme directs new applicants to NMLS and no longer accepts paper license applications. Confirm the separate bond-document delivery and dates instead of treating an older paper specimen as the current licensing process.
