New Jersey — Collection Agency Bond

New Jersey requires an annual collection agency bond filing backed by $5,000 security. Arrange the business registration and complete State filing, not just the bond purchase. The Division sends the bond registration after Attorney General review.

What this bond does

The published bond requires the agency, on written demand, to turn over collection proceeds according to the agreement under which it received the account. It also requires faithful observance of laws relating to the collection business covered by the act.

Who needs it
Collection agencies, bureaus and offices, and businesses collecting or receiving payment for others on accounts, bills or other indebtedness within the statutory scope. Use the actual corporate, trade-name or individual principal and complete the applicable New Jersey business registration before filing.
Who it protects
The bond is to New Jersey for the use of a party aggrieved within the act's meaning. The published model binds principal and surety jointly and severally for the specified proceeds-turnover and business-law conditions. It is broader than merely recording that the agency has purchased a bond.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

The Division requires the collection agency bond application annually. The statutory text in its published packet sets a one-year bond term from its date, with annual renewal, and a two-year limit after expiration for beginning an action on the bond. That action period is not a two-year purchasing term.

Match the principal to the business structure and registration. The packet provides different principal acknowledgments for corporations and for individuals or trade names. A corporation uses its secretary's acknowledgment and corporate seal; the instructions identify the designation for a sole corporate officer.

Coordinate execution with the surety and acknowledgment officer. The current Division guidance requires two witnesses other than the principal for each signature. Follow its remote-notarization wording if used. The packet's execution instructions and the current Division guidance should be handled together, rather than signing the application alone and sending an incomplete acknowledgment.

Submit the bond application and appropriate acknowledgment with the surety's current financial statement and executed power of attorney establishing its attorney-in-fact's authority. The packet says the surety statement must be no more than a year old. This is the surety's financial document, not a substitute statement of the agency's own finances.

Purchase Now opens Propeller's New Jersey collection agency application in a new tab. Have the legal principal, business registration and State request ready. Obtain the properly executed bond and supporting surety documents, then send the complete filing to the Division as instructed. Checkout does not register the bond; the State reviews the filing and mails the registration.

Questions about this bond

Does paying online register the New Jersey bond?

No. The Division requires the completed State filing with the supporting documents. After Attorney General review, the bond registration is mailed to the applicant.

Whose financial statement goes with the filing?

The published instructions call for the surety's current, complete and authorized financial statement, no more than a year old. Arrange that document with the issuing surety rather than substituting the agency's own statement.

Is the bond's two-year action limit its purchasing term?

No. The statutory text in the State packet sets a one-year term from the bond's date and annual renewal. It separately says an action on the bond must begin within two years after expiration.
