New York — Wholesale Dealer Of Cigarettes Bond

New York's ordinary cigarette wholesale-dealer application requires a $10,000 surety bond under section 480. Its separate $25,000 net-worth criterion is financial-responsibility evidence, not the bond's face amount.

What this bond does

Match the State wholesale license and actual cigarette activity. Licensing security for Articles 20 and 20-A violations is distinct from an appointed agent's stamp-credit security.

Who needs it
Applicants for New York State cigarette wholesale licensing, subject to the statute's actual activity-based exceptions. A license application based solely on vending machines on others' premises is treated differently.
Who it protects
Section 480 requires a State-authorized, financially approved surety bond securing payment of any sums due for violations of Article 20, Article 20-A or the Commissioner's regulations. That includes the cigarette marketing-standards obligation, not only the purchase price of stamps.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for New York cigarette wholesale licensing

The $10,000 bond and $25,000 net-worth evidence are separate section 480(1) requirements. Paragraph 1(l) exempts specified applications based solely on vending machines on others' premises, solely on statutory tobacco-products resale, or those two together. Do not treat that other-tobacco exception as a blanket cigarette-wholesaler waiver.

Section 480 also calls for a secure separate warehouse, with deed or an executed lease for at least two years, and other applicant evidence. A bond does not replace the licensing investigation or make the license assignable to a buyer of the business.

Failure to maintain required or increased security can cause license cancellation/suspension. The license normally continues until revoked, suspended or surrendered, with statutory reapplication powers; that is not a universal annual expiration date for the bond.

The current State reporting page requires quarterly informational returns from licensed cigarette wholesalers, including those also acting as agents, but excludes vending-machine-only wholesalers. Its quarters end in May, August, November and February, with returns due the following June 20, September 20, December 20 and March 20, subject to nonbusiness-day rules. Agents have additional reporting.

Match the legal license applicant, actual cigarette role, required security and accepted dates, then complete State licensing/security filing. Provider payment does not license the dealer, grant stamp credit or replace quarterly returns.

Questions about this bond

Is the $25,000 net-worth figure my bond amount?

Section 480 separates net-worth evidence from the ordinary $10,000 surety requirement. Use the actual applicable request and exception rules.

Does a wholesale license automatically grant stamp credit?

Wholesale licensing security covers Article 20 and 20-A violation sums. Appointment/credit security for a cigarette agent is a different requirement.

Do wholesalers that are also agents still report quarterly?

The current reporting page includes them and notes additional agent filings. Its vending-machine-only exception should not be extended to every wholesale account.
