North Carolina — Collection Agency Foreign Bond # 2 (UPDATED)
Foreign collection agency Bond #2 is North Carolina's $10,000 security for specified Department of Insurance examination expenses. Check that your permit request calls for #2, rather than the separate client-funds bond. The UPDATED label on this purchase option does not replace checking the issued form against DOI's current request.

What this bond does
This bond reimburses DOI for visiting and examining a nonresident collection agency in connection with a federal bankruptcy or State receivership proceeding involving that agency. It does not cover ordinary examinations generally or substitute for the agency's separate client-funds security.
- Who needs it
- Collection agencies applying for or maintaining the foreign classification in North Carolina. DOI bases that classification on incorporation within the United States but outside North Carolina. An office's street or mailing address alone does not determine the domicile classification.
- Who it protects
- Section 58-70-20(c) makes DOI the beneficiary for those specified expenses. The official foreign #2 form binds the principal and surety jointly and severally for $10,000, with aggregate surety liability limited to the bond amount. The foreign packet's #1 obligation protects collection clients separately.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Have these ready
- Confirm the permit holder's foreign domicile classification and bring its legal name, FEIN and permit/application details.
- Check that DOI requests #2 state-expense security, separate from #1 client-funds security.
- Have the requested effective dates and arrange the principal/surety signatures, seals and surety acknowledgment.
- Review the issued condition against DOI's current foreign #2 form and use DOI's bond-filing instructions.
Questions about this bond
What expenses does #2 cover?
DOI's costs of visiting and examining the agency in connection with a federal bankruptcy or State receivership in which the agency is the subject. It is not a general guarantee of the agency's debts or its separate client-funds obligation.
Does UPDATED identify a legally different bond?
It is this purchase option's label. The controlling obligation is foreign #2 under section 58-70-20(c). Check the actual issued wording, dates and execution against DOI's accepted form rather than relying on the label alone.
Does a new #2 bond release an existing surety?
The official model allows release after the Commissioner accepts replacement security and gives the old surety written notice of release. Buying a new document does not establish that acceptance or release.
