Odessa, TX — Right Of Way Construction Bond

What this bond does

Provides the construction/restoration security described in Odessa's ROW construction requirements for the covered city permit activity.

Who needs it
Permit applicants doing covered work in Odessa city ROW who are not covered by an applicable exemption or accepted alternative.
Who it protects
The published requirement conditions the bond on city-code/specification compliance and filling/restoring openings and excavations to good, safe condition as near as practical to their original condition.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Confirm the $10,000 or qualifying $2,000 arrangement

Section 16-44 of the city's published requirements calls for a city-furnished form and $10,000 security before permit issuance. It permits $2,000 security where work under any one acquired permit will not exceed $2,000 in value. Have Engineering confirm that limitation rather than treating $2,000 as an option for larger work.

Check the applicant and any accepted alternative

The published ordinance lists exceptions, including work by the owner-occupant homeowner in ROW abutting the home. Separately, the contractor packet's plumbing section allows contractors with insurance exceeding $300,000 to furnish a certificate to Engineering in lieu of the city ROW bond; it expressly excludes state ROW. Obtain Engineering's confirmation before relying on an exception or certificate.

General-contractor registration and its document checklist are separate from this ROW requirement. Do not assume a registration statement about no general bond requirement authorizes all street or excavation work.

Use the initial permit date and finish the approval process

The published requirement describes an annual bond from the first work permit, or until work under permits granted within that year is complete. Do not assume a fixed end date one year after purchase.

Use the existing RLI option with the confirmed city request. After issuance, submit the security and other required material for permit review. The city requirements also call for approved plans and a work-site placard; bond issuance does not provide those approvals.

Sources

Have these ready

  1. Identify the city ROW work and construction value under each permit.
  2. Confirm required amount, city form and any exemption/accepted plumbing certificate alternative.
  3. Prepare the legal applicant, initial work-permit reference and required dates.
  4. Submit issued security and permit material, then obtain approved plans and site authorization.

Questions about this bond

Can every Odessa applicant choose $2,000 security?

No. The published requirement limits that arrangement to work not exceeding $2,000 in value under any one acquired permit. Confirm eligibility with Engineering.

Does the plumbing insurance alternative also cover state ROW?

The contractor packet expressly says it does not apply to state ROW. Ask Engineering whether its city ROW alternative applies to your actual request.

Does annual mean one year after I buy the bond?

The published requirement ties the period to the initial work permit and completion of work under permits issued within the covered year. Match the issued instrument to that request.
