Oregon — Collection Agency - NMLS Bond
Oregon collection agency registration uses an electronic surety bond through NMLS. DFR lists $10,000 for ordinary applicants and $15,000 for an out-of-state company with neither an Oregon location nor an Oregon trust account. If you seek a location or trust-account waiver, have DFR confirm your required amount and waiver before ordering.

What this bond does
The statutory bond condition requires compliance with ORS 697.005 through 697.095 and the Director's rules, and payment of money owed to the State and people entitled to it under those provisions. It is broader than a promise to remit one client's collections.
- Who needs it
- Individuals and companies registering as Oregon collection agencies, including covered third-party debt collection and collateral repossession businesses. Out-of-state applicants should identify their office and trust-account arrangements and any waiver request in the company NMLS filing.
- Who it protects
- The bond runs to Oregon for the State and people with a cause of action under the collection agency provisions. A person with a judgment for a violation or other misconduct may pursue the bond in an Oregon circuit court for the amount not recovered by executing the judgment against the agency. Surety liability is aggregate and does not grow with renewals or continuation certificates.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Questions about this bond
Does every out-of-state company automatically use $15,000?
DFR's programme lists $15,000 where there is no Oregon location or trust account. Its waiver form also includes licensing-history qualifications and additional security as an alternative. Have DFR determine your waiver and bond amount before ordering; an out-of-state mailing address alone is not the whole assessment.
Does a trust-account waiver let me use operating funds?
No. Form 5218 says the waiver concerns keeping the trust account at an Oregon financial institution. You must still have a separate trust account and enter its information in the NMLS company MU1.
Does renewal replenish the aggregate protection?
ORS 697.031 says continuations, reinstatements, reissues and renewals do not increase the surety's aggregate liability. Keep the required security continuously in force and treat registration renewal separately.
